<br />I <br /> <br />I <br /> <br />I <br /> <br />80 <br /> <br />RESOLUTION NO. 1979-25-R <br /> <br />RESOLUTION ORDERING A SPECIAL ELECTION <br /> <br />THE STATE OF TEXAS X' <br />THE COUNTY OF HAYS X <br /> <br />CITY OF SAN MARCOS <br /> <br />On this, the 9th day of April, 1979, the City Council of <br />the City of San Marcos, Hays County, Texas, convened in ~gular <br />Session at the regular meeting place at City Hall in said City, <br />with the following members present: <br /> <br />Mayor Robert L. Cavazos, Council Members Breihan, <br />Hansen, Hyatt, James and Sutton, and City Secretary <br />Hambrick: and <br /> <br />those absent were: <br /> <br />NONE. <br /> <br />WHEREAS, no candidate for Place 6 in the Regular City <br />Election held April 7, 1979, received a majority of the total <br />vote, as required by Sec. 5;5 of the Charter of the City of <br />San Marcos: and, <br /> <br />WHEREAS, the two candidates receiving the largest number <br />of votes in Place 6 were Berry R. James and Fred Guerra: <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS: <br /> <br />That a special election be held in said City on the 5th <br />of May, 1979, to determine the winning candidates for Place 6. <br /> <br />Doriss Hambrick is hereby appointed Clerk for absentee <br />voting and Mary Castillo and Julie villanueva are hereby appointed <br />Deputy Clerks for absentee voting. The absentee voting shall be <br />held at City Hall within said City and said place of absentee <br />voting shall remain open for at least eight hours on each day for <br />absentee voting which is not a Saturday, a Sunday, or an <br />official State holiday, beginning on the 16th day and continuing <br />through the 30th day preceding the date of said election. Said <br />place of voting shall remain open between the hours of 8:00 a.m. <br />and 5:00 p.m. on each day for said absentee voting. The above <br />described place for absentee voting is also the absentee clerk's <br />mailing address to which ballot applications and ballots voted <br />by mail may be sent. <br /> <br />That said election shall be held in accordance with the <br />Election Code of this State and only resident qualified voters <br />of said City shall be eligible to vote at said election. <br /> <br />Notice of said election will be given in accordance with <br />the Election Code, and the City Secretary is hereby instructed <br />to have said notice posted and/or published in accordance with <br />said Article 4.05. <br /> <br />IinInediately after said election is held, the officers <br />fiolding same shall make returns of the result thereof to the <br />Mayor of this City as required by the Election Code of this <br />state. <br /> <br />A copy of this Resolution shall also serve as a writ of <br />election which shall be delivered to the above appointed <br />Presiding Judges, for said election. <br />
