~ I I I, ORDINANCE NO. 1979-2Zb 140 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, CLOSING, VACATING AND ABANDONING A PORTION OF GRACE STREET IN THE ROSE HILL ADDITION TO THE CITY OF SAN MARCOS, TEXAS; PROVID- ING FOR THE REVERSION OF THE FEE IN SAID LAND; AND SETTING AN EFFECTIVE DATE. WHEREAS, Grace Street in the City of San Marcos, Texas, was and is dedicated to public use as shown by the plat of the Rose Hill Addition to said City, as shown bf record in Volume 58, Page 396, Hays County Deed Records; and, WHEREAS, the City Council of the City of San Marcos, Texas, has determined that it is in the public interest to close, vacate and abandon a portion of said Grace Street, said portion being fully described in Exhibit A which is attached hereto and incorporated herein for all intents and purposes; and, WHEREAS, the owner of all land abutting said portion of Grace Street has executed a release, discharging said City from any damages occasioned by said abandonment; and, WHEREAS, pursuant to Article 5421c-12~2(b), Texas Revised Civil Statutes, the public easement in said portion of Grace Street is being sold to said abutting owner; and, WHEREAS, pursuant to Article 5421c-12~4, Texas Revised civil Statutes, said sale is for the fair market ,value of said interest being conveyed, said fair market value having been determined by an appraisal obtairr~d by said City; now, therefore, BE IT ORDALNED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the portion of Grace Street in the Rose Hill Addition to the City of San Marcos, Texas, as shown by Exhibit A be, and is hereby, closed, abandoned and permanently vacated as a public thoroughfare of any kind or character whatever. SECTION 2. That the fee to the land in the portion of Grace Street described in Exhibit A is hereby released and shall revert to San Marcos Baptist Academy save and except that easements are reserved for any and all existing utilities. SECTION 3. That this Ordinance shall be effective ten (10) days from and after its passage and publication in a newspaper of general circulation. PASSED AND APPROVED on first reading May 29, 1979.
