<br />I <br /> <br />I <br /> <br />I <br /> <br />ORDINANCE NO. 1979-23 <br /> <br />142 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, ANNEXING TO <br />SAID CITY A CONTIGUOUS TRACT OF LAND <br />CONTAINING 167.03 ACRES LOCATED WITHIN <br />THE EXTRATERRITORIAL JURISDICTION OF SAID <br />CITY AND LYING ADJACENT TO PRESENT CITY <br />BOUNDARIES; AND ESTABLISHING AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, W. C. Carson, President of San Marcos Industrial <br />Foundation, the record owner of a tract of land containing <br />167.03 acres, which land is contiguous and adjacent to present <br />boundaries and located within said City's extraterritorial <br />jurisdiction, has duly petitioned by written petition, the City <br />of San Marcos to annex said tract to be hereafter incorporated <br />for all purposes within the boundaries of said City; and, <br /> <br />WHEREAS, said petition has been heard and considered by <br />the City Council; and, <br /> <br />WHEREAS, a copy of said petition is attached hereto and <br />incorporated herein for all intents and purposes as Exhibit A; <br />and, <br /> <br />WHEREAS, a description of said tract by metes and bounds <br />is attached hereto and incorporated herein for all intents and <br />purposes as Exhibit B; and, <br /> <br />WHEREAS, an opportunity ha~ been, provided after proper <br />notice for all interested persons. to be hea~d on the matter of <br />said petition at a public hearing held on Miy 21, 1979, said <br />date being not less than ten (10) days nor more than twenty <br />(20) days prior to the first reading of this ordinance; and, <br /> <br />WHEREAS, said petition for annexation should be and is <br />hereby granted; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />PART 1. That the 167.03 acre tract, part of and out of <br />the J. M. Veramendi League #2, and being part of that 135.169 <br />acre tract conveyed by Cone Mills Corporation to Hays County <br />Industrial Development Foundation and San Marcos Industrial <br />Foundation, Inc. recorded in Volume 244, Page 6 of the Hays <br />County Deed Record and also being part of that tract of 34.414 <br />acres conveyed by the Hays County Industrial Development <br />Foundation to the San Marcos Industrial Foundation, Inc. <br />recorded in Volume 244, Page 21 of the Hays County Deed <br />Records and to being part of that 169.583 acre tract conveyed <br />by Hays County Industrial Development Foundation, Inc. and <br />recorded in Volume 262, Page 345 of the Hays County Deed <br />Records and including that 0.50 acre tract conveyed by C. C. <br />Holt, et ux., to the San Marcos Industrial Foundation, Inc. <br />recorded in Volume 316, Page 387 of the Hays County Deed <br />Records, and owned by San Marcos Industrial Foundation, Inc., <br />said tract being more ful1y described by metes and bounds <br />description in Exhibit B attached hereto and incorporated <br />herein, be and is hereby annexed into the incorporated area <br />of the City of San Marcos. <br /> <br />PART 2. That the corporate limits of sai,d City be and <br />are hereby extended to include said newly annexed 167.03 <br />acre tract. <br /> <br />PART 3. That said 167.03 acre tract shall henceforth <br />be a part of the City of San Marcos, and any inhabitants <br />thereof shall be entitled to all the rights and privileges <br />of all citizens, and shall be bound by the acts and ordinances, <br />resolutions and regulations of the City. <br />
