<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, PROVIDING THAE THAT POR-
<br />TION OF THAT UNNAMED STREET DEDICATED IN THE
<br />PLAT OF THE CHARLES MEINERS ADDITION IDO THE
<br />CITY OF SAN MARCOS, TROM U.S. HIGHWAY 81 TO
<br />MILL STREET AND THAT PORTIONS OF THOSE ALLEYS
<br />REMAINING OUT OF THE W.O. MEINERS FIRST SUB-
<br />URBAN ADDITION roo THE CITY OF SAN MARCOS, BE
<br />VACATED, ABANDONED, AND CLOSED; PROVIDING FOR
<br />THE REVERSION OF THE FEE IN SAID LANDS TO THE
<br />ADJACENT PROPERTY OWNERS; DIREETING THE MAYOR
<br />TO EXECUTE AND DELIqER ~UITCLAIM DEEDS TO SAID
<br />OWNERS; AND PROVIDING FOR AN EFFECTIVE DATE.
<br />
<br />WHEREAS, the map or plat of the Charles Meiners Addition to the City
<br />of San Marcos,ref1ects an unnamed 35 foot wide street which separates
<br />that addition from the W.O. Meiners First Suburban Addition to the
<br />City of San Marcos; and,
<br />
<br />WHEREAS, said unnamed street has never been graded, paved, or in anywise
<br />improved by the City of San Marcos for use by the public as a passage-
<br />way; and,
<br />
<br />WHEREAS, the City of San Marcos has no intent to ever devote this
<br />dedicated, but unimproved, street to use as a public Bight-of-way; and,
<br />
<br />WHEREAS, the map or plat of the W.O. Meiners First Suburban Addition
<br />to the City of San Marcos, reflects two alleys, one alley being 15.
<br />feet in width and the other beeng 18 feet in width, which have been
<br />severely reduced in length because of the construction of U.S. Highway
<br />81, also known as Loop 82; and,
<br />

<br />WHEREA.S, tHe remnants of said two alleys, less a portion of said alleys
<br />to be reserved for future use in improving Mill Street, are not now
<br />being used by the public, nor does the City of San Marcos foresee any
<br />future use for said alley remnants; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />Part 1. That that portion of that unnamed street eedicated in the plat
<br />of the Charles Meiners Addition to the City of San Marcos from U.S.
<br />Highway 81 to Mill Street be, and is hereby, closed, abandoned, and
<br />vacated as a street or public thoroughfare.
<br />
<br />Part 2. That the fee to the land is the above described portion of
<br />said street (as shown on Exhibit "A" attached hereto) is hereby re-
<br />leased to the adjacent owners, save and except that easements are
<br />reserved for any and all existing utilities.
<br />
<br />Part 3. That portions mill those two hereinabove described alleys, less
<br />a portion of said alleys to be reserved for future use im improving
<br />Mill S.treet, (as shown on Exhibit" A" attached hereto), be, and are
<br />hereby, closed, abandoned, and vacated as public alleys.

<br />Part 4. That the fee to the land in said alleys (as shown on Exhibit
<br />"A" attached hereto) is hereby released to the adjacent owner, save
<br />and except that easements are reserved for any and all existing
<br />utilities.
<br />
<br />Part 5. That the Mayor of the City of San Marcos is hereby authorized,
<br />empowered, and directed to execute and deliver quitclaim deeds to the
<br />owners of the adjacent real property, which relinquish to said owners
<br />all right, title, and interest of the City of San Marcos to those por-
<br />tions of the alleys and/or streets adjacent to other real property
<br />owned by said persons.
