<br />I <br /> <br />..,.. <1.1 <br /> <br />ORDINANCE NO. 1978-4 <br /> <br />AN ORDINANCE Of 'mE CITY COUNCIL Of 'mE CITY Of <br />SAN MARCOS, TEXAS, VACATING AND ABANDONING 'mE <br />AlLEY IN BWCK 15 Of THE WESTOVER ADDITION TO <br />THE CITY Of SAN MARCOS; AUTIlORIZING 'mE MAYOR <br />TO EXECUI'E QUITClAIM DEEDS RELEASING 'mE CITY'S <br />RIGHT, TITLE AND INTEREST IN AND TO SAID AlLEY <br />TO 'mE AWACENT PROPERTY OWNERS; AND DEClARING <br />AN EMERGENCY. ' <br /> <br />WHEREAS, the plat of the Westover Addition of the City of San Marcos, Texas, <br />filed of record in Volume 59, Pages 184-185, of the Hays County Deed Records, <br />indicates an alley in block 15 of said addition, said alley rwming parallel <br />to Bishop Street and Allen Street; and, <br /> <br />WHEREAS, although the deed of dedication, of record in Volume 59, Page 183 of <br />the Hays' County Deed Records, which accompanies the plat gives and donates to <br />the use of the public all alleys sh= on the plat, the alley in block 15 of <br />Westover Addition has never been opened or used by the public for any purposes <br />whatsoever; and, <br /> <br />WHEREAS, the City of San Marcos does not intend to ever open this alley for' <br />publcic use; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of SAN MARCOS, TEXAS: <br /> <br />Section 1. That the alley in block 15 of the Westover Addition to the City of <br />San Marcos, as shown on the plat of said addition filed in the Hays County <br />Deed Records, from Del.m3:r> Street to Earle Street, be, and is hereby, abandoned <br />and perrranently vacated as a public alley of any kind or character whatevel'. <br /> <br />I <br /> <br />Section 2. That the fee to the land in the above described alley is hereby <br />released to the adjacent owners. <br /> <br />Section 3. That the Mayor of the City oFSan Marcos is hereby authorized, em- <br />powered, and directed to execute and deliver quitclaim deeds to the owners <br />of the adjacent real property, which relinquish to said owners all of the City's <br />right, title, and interest to such alley adjacent to other real property milled <br />by such persons. <br /> <br />Section 4.
