<br />I <br /> <br />30 <br /> <br />.. <br /> <br />ORDINANCE 1978-6 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, REPEALING THAT <br />ORDINANCE PROHIBITING DISORDERLY CONDUCT, <br />AS CODIFIED IN CHAPTER 16, ARTICLE I, SEC- <br />TION 16-5 OF THE CODE OF ORDINANCES OF THE <br />CITY OF SAN MARCOS; DECLARING AN EMERGENCY; <br />AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the Texas Penal Code provlslons upon which Section 16-5 of <br />the Code was founded are no longer if effect; and, <br /> <br />WHEREAS, City prosecution of disorderly conduct complaint is now <br />governed by Chapter 42 of the revised Texas Penal Code; and, <br /> <br />WHEREAS, Section 16-5 of the Code is in conflict with State Law; <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Part 1. That Section 16-5, of the Code of Ordinances of the City of <br />San Mar,cos , entitled "Disorderly Conduct", is hereby repealed. <br /> <br />Part 2. That the importance of this Ordinance creates an emergency <br />and an imperative purpose necessary that the provisions of the City <br />Charter requiring all ordinances to be read at three separate meetings <br />and that no ordinance shall become effective until the expiraticn <br />of ten (10) days following the date of its final passage, be suspended. <br /> <br />Part 3.
