<br />56 <br /> <br />ORDINANCE NO. 1978-11 <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING THAT <br />ORDINANCE PROVIDING FOR FEES FOR THE IM- <br />POUNDMENT OF ANIMALS, SAID ORDINANCE BE- <br />ING RECORDED IN VOLUME 40 PAGE 63 OF THE <br />MINUTES OF THE CITY COUNCIL AND CODIFIED <br />AS SECTION 3-46 OF THE CODE OF ORDINANCES <br />OF THE CITY OF SAN MARCOS, BY INCREASING <br />SPECIFIED FEES; AND ESTABLISHING AN EFFEC- <br />TIVE DATE. <br /> <br />WHEREAS, the present cost to the City for operating an animal control <br />program is in excess of $30,000.00 per year; and, <br /> <br />WHEREAS, the cost of animal food is presently $900.00 per year as <br />compared to offsetting fees and charges collected amounting to only <br />$300.00 per year; and, <br /> <br />WHEREAS, said fees established to provide for the expense of impound- <br />ing certain animals are no longer adequate; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Part 1. That Section 3-46 of the Code of Ordinances of the City of <br />San Marcos, being recorded in Volume 40 Page 63 of the Minutes of <br />the City Council be, and is, hereby, amended to read as follows: <br /> <br />I <br /> <br />There shall be charged a pound fee of three dollars ($3.00) <br />for every dog, and five dollars ($5.00) for every cow, horse, <br />jack, jennet, sheep, goat or like animal impounded under the <br />provision of this article; and an additional fee of two dollars <br />($2.00) per day for each day or fraction thereof that any dog <br />remains in Slch pound; and two dollars ($ 2. 00) per day or fract ion <br />thereof that any cow, horse, jack, jennet, sheep, goat or 1i~e <br />animal remains in such pound. <br /> <br />Part 2.
