56 ORDINANCE NO. 1978-11 I AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THAT ORDINANCE PROVIDING FOR FEES FOR THE IM- POUNDMENT OF ANIMALS, SAID ORDINANCE BE- ING RECORDED IN VOLUME 40 PAGE 63 OF THE MINUTES OF THE CITY COUNCIL AND CODIFIED AS SECTION 3-46 OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, BY INCREASING SPECIFIED FEES; AND ESTABLISHING AN EFFEC- TIVE DATE. WHEREAS, the present cost to the City for operating an animal control program is in excess of $30,000.00 per year; and, WHEREAS, the cost of animal food is presently $900.00 per year as compared to offsetting fees and charges collected amounting to only $300.00 per year; and, WHEREAS, said fees established to provide for the expense of impound- ing certain animals are no longer adequate; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: Part 1. That Section 3-46 of the Code of Ordinances of the City of San Marcos, being recorded in Volume 40 Page 63 of the Minutes of the City Council be, and is, hereby, amended to read as follows: I There shall be charged a pound fee of three dollars ($3.00) for every dog, and five dollars ($5.00) for every cow, horse, jack, jennet, sheep, goat or like animal impounded under the provision of this article; and an additional fee of two dollars ($2.00) per day for each day or fraction thereof that any dog remains in Slch pound; and two dollars ($ 2. 00) per day or fract ion thereof that any cow, horse, jack, jennet, sheep, goat or 1i~e animal remains in such pound. Part 2. That this Ordinance shall become effective ten (10) days from and after its final passage. PASSED AND APPROVED on first reading January 30, 1978.
