<br />AN ORDINANCE OF THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS, TEXAS, ACCEPTING THE
<br />OFFER OF PEDRO AND FRANCISCA RODRIGUEZ
<br />FOR THE PURCHASE OF PART OF LOTS 21) 3, 4,
<br />6 AND ALL OF LOTS 7 AND 8, BLOCK 11, D. S.
<br />COMBS ADDITION; AUTHORIZING THE MAYOR TO
<br />EXECUTE A SPECIAL WARRANTY DEED TO SAID
<br />PEDRO AND FRANCISCA RODRIGUEZ ON BEHALF
<br />OF THE CITY OF SAN MARCOS, IN TRUST FOR
<br />ITSELF THE STATE OF TEXAS, COUNTY OF HAYS
<br />AND THE SAN MARCOS CONSOLIDATED INDEPENDENT
<br />SCHOOL DISTRICT; AND DECLARING AN EMERGENCY.
<br />WHEREAS, the City of San Marcos acquired all that right, title
<br />and interest conveyed by Sheriff's Deed, dated March 24, 1962,
<br />in and to part of Lots 2, 3, 4, 6 and all of Lots 7 and 8,
<br />Block 11, D. S. Combs Addition to the City of San Marcos, as
<br />trustee for itself, the State of Texas, the County of Hays, and
<br />the San Marcos Consolidated Independent School District; and,
<br />WHEREAS, said property was not redeemed by its owners within the
<br />statutory period; and,
<br />WHEREAS, the City Council desires to return this property to
<br />private ownership; now, therefore,
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />Section 1. That the proferred payment of Pedro and Francisca
<br />Rodriguez, in the amount of $3,137.63 for part of Lots 2, 3, 4, 6
<br />and all of Lots 7 and 8, Block 11, D. S. Combs Addition to the City
<br />of San Marcos, Hays County, Texas, be accepted.
<br />Section 2. That the Mayor of the City of San Marcos, Frank T.
<br />Arredondo, be, and is hereby, authorized to execute a special
<br />warranty deed to Pedro and Francisca Rodriguez for said property on
<br />behalf of the City of San Marcos, in trust for itself, the State of
<br />Texas, the County of Hays, and the San Marcos Consolidated Independent
<br />School District.
<br />Section 3. That the importance of this Ordinance creating an
<br />emergency and an imperative purpose necessary that the provision of
<br />the Charter reading that all ordinances be read at three separate
<br />meetings and that no ordinance shall become effective until the
<br />expiration of ten (10) days following the date of its final passage,
<br />be suspended, and this provision is hereby suspended, and this
<br />ordinance shall take effect and be in force from and after its
<br />adoption, and publication within the City.
<br />ADOPTED this 27th day of February, 1978.
