<br />I <br /> <br />I <br /> <br />I <br /> <br />85, <br /> <br />ORDINANCE NO. 1978-20 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE PRICE AND <br />CONDITIONS OF THE SALE BY THE CITY OF SAN MARCOS, <br />TEXAS, OF ALL OF LOT 5 AND A PORTION OF LOT 4, <br />BLOCK 2, IN THE KATI ADDITION FURTHER DESCRIBED <br />BY MErES AND BOUNDS IN ATTACHED "EXHIBIT A", <br />LOCATED WITHIN THE TEX. A-6, NEIGHBORHOOD DEVELOP- <br />MENT PROGRAt'1 AREA TO JAMES M. HARRISON AND LEWIS <br />E. HARRISON, JR.; AUTHORIZING THE MAYOR TO EXECUTE <br />A WARRANTY DEED TO JAMES M. HARRISON AND LEWIS E. <br />HARRISON, JR.; AND PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of San Marcos, Texas, advertised for bids for the sale of that <br />certain real property known as all of Lot 5 and a portion bf Lot 4, Block 2, in <br />the Katy Addition further described by metes and bounds in attached "Exhibit A", <br />located within the Tex. A-6, Neighborhood Development Program area, in th" <br />San Marcos Record, a local newspaper with a general circulation in the County of <br />Hays, State of Texas; and, <br /> <br />WHEREAS, pursuant to said advertisement a bid was submittea by James M. Harrison <br />and Lewis E. Harrison, Jr. for said all of Lot 5 and a portion of Lot 4, Block 2, <br />in the Katy Addition further described by metes and bounds' in attached "Exhibit A",: <br />and, <br /> <br />WHEREAS, the said bid met the minimum disposition price set upon said property by <br />the Board of Commissioners of the Urban Renewal Agency of the City of San Marcos, <br />Texas; and, <br /> <br />WHEREAS, the said Board accepted the bid as the highest and best responsible bid <br />for said property by a motion duly passed on December 6, 1977, after the bid <br />opening of December 6, 1977; and, <br /> <br />WHEREAS, said motion also approved the terms and conditions for the sale of the <br />said property and recommended the approval of said purchase price and the approval I <br />of the terms and conditions for the sale, as contained in the bid documents, by <br />the City Council of the City of San Marcos, Texas; and, <br /> <br />WHEREAS, the aforementioned bid and proposed use set forth in said bid and the <br />sales terms and conditions pertinent thereto conform to the Redevelopment Plan <br />for the development of the City as a whole; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY QF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That the terms and conditions of the sale by the City of San Marcos, <br />Texas, of all of Lot 5 and a portion of Lot 4, Block 2, in the Katy Addition <br />further described by metes and bounds in attached "Exhibit A", are hereby approved I <br /> <br />SECTION 2. That the consideration for the sale for said property being $20,160.00 I <br />for 22,215.6 square feet is hereby approved. <br /> <br />SECTION 3. That the sale by the City of San Marcos is made subject to r"striction <br />of the Redevelopment Plan for the Tex. A-6, Neighborhood Development Program, as <br />approved and amended, said plan is on file and is available for inspection in the <br />Office of the Director of Community Development of the City of San Marcos. <br /> <br />SECTION 4. That the conditions of the disposition documents, including the Deed <br />and Contract for Sale for Private Redevelopment, are on file and are available <br />for inspection in the Office of the Director of Community Development of the City <br />of San Marcos. <br /> <br />SECTION 5. That the purchaser is hereby placed on notice that the subj ect propert <br />is subject to assessment under the provisions of Article 1105b of the Revised <br />Civil Statutes of the State of Texas. <br /> <br />SECTION 6. That the Mayor of the City of San Marcos, Texas, is hereby authorized <br />to execute a warranty deed to James M. Harrison and Lewis E. Harrison, ~r. from <br />the City of San Marcos, for all that real property known as all of Lot " and a <br />portion of Lot 4, Block 2, in the Katy Addition further described by metes and <br />bounds in attached "Exhibit A", located within the Tex. A-6, Neighborhood Develop <br />ment Program. <br />
