<br />157 <br /> <br />ORDINANCE NO. 1977 - 1 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING TRE PRICE AND TERMS AND CONDITIONS OF THE <br />SALE BY THE CITY OF SAN MARCOS, TEXAS OF PARCEL NO. 9-1, <br />DESCRIBED FURTHER ON EXHIBIT "A" ATTACHED HERETO, LOCATED <br />WITHIN THE TEX. A-6, NEIGHBORHOOD DEVELOPMENT PROGRAM AREA, <br />TO PEDRO (PETE) RODRIGUEZ, AUTHORIZING THE MAYOR TO EXECUTE <br />A WARRANTY DEED TO PEDRO (PETE) RODRIGUEZ. <br /> <br />I <br /> <br />WHEREAS, the City of San Marcos, Texas advertised for bids for the sale of that <br />certain real property known as Parcel No. 9-1, and described more fUlly on <br />Exhibit "A" attached hereto, located within the Tex. A-6, Neighborhood Development <br />Program area, in the San. MancossRecord,aallocal newspaper with a general circula- <br />tion within the County of Hays, State of Texas; and <br /> <br />WHEREAS, pursuant to said advertisement a bid was submitted by Pedro (Pete) <br />Rodriguez for said Parcel No. 9-1; and <br /> <br />WHEREAS, the said bid met the minimum disposition price set upon said property <br />by the Board of Commissioners of the Urban Renewal Agency of the City of San <br />Marcos, Texas; and. <br /> <br />WHEREAS, the said Board accepted the bid as the highest and best responsible bi.d <br />for said property by a Resolution duly passed on November 9, 1976, after the b:Ld <br />opening of November 9, 1976; and <br /> <br />WHEREAS, said Resolution also approved the terms and conditions for the sale of <br />the said property and recommended the approval of said purchase price and the <br />approval of the terms and conditions for the sale, as contained in the bid docu- <br />ments, by the City Council of the City of San Marcos, Texas; and <br /> <br />I <br /> <br />WHEREAS, the aforementioned bid and proposed use set forth in said bid and the <br />sales terms and conditons pertinent thereto conform to the Redevelopment Plan for <br />the development of the City as a whole; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section 1. That the terms and conditions of the sale by the City of San Marcos, <br />Texas of Parcel No. 9-1 within the Tex. A-6, Neighborhood Development Program area, <br />and more fully described on Exhibit J:A" attached hereto to Pedro (Pete) Rodriguez <br />are hereby approved. <br /> <br />Section 2. That the consideration for the sale for said property being $13,347.50 <br />for 40,447 s<J.uare feet is hereby approved. <br /> <br />Section 3. That the sale by the City of San Marcos is made ~ubject to restrictions <br />of the Redevelopment Plan for the Tex. A-6, Neighborhood Development Program, as <br />approved and amended, said plan is on file and is available for inspection in the <br />Office of the Director of Community Development of the City of San Marcos, <br /> <br />Section 4. That the conditions of the disposition documents, including the <br />Deed and Contract of Sale for Private Redevelopment, are on file and are available <br />for inspection in the Office of the Director of Community Development of the City <br />of San Marcos. <br /> <br />Section 5. That the purchaser is hereby placed on notice that the subject property <br />is subject to assessment- under the provisions of Article 1105b of the Revised Civil <br />Statutes of the State of Texas. <br /> <br />I <br /> <br />Section 6. That the Mayor of the City of San Marcos is hereby authorized to <br />execute a warranty deed to Pedro (Pete) Rodriguez, from the City of San Marcos, for <br />all that real property known as Parcel No. 9-1, located within the Tex. A-6, <br />Neighborhood Development Program, and described more fully on Exhibit "A" attached <br />hereto. <br />
