157 ORDINANCE NO. 1977 - 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING TRE PRICE AND TERMS AND CONDITIONS OF THE SALE BY THE CITY OF SAN MARCOS, TEXAS OF PARCEL NO. 9-1, DESCRIBED FURTHER ON EXHIBIT "A" ATTACHED HERETO, LOCATED WITHIN THE TEX. A-6, NEIGHBORHOOD DEVELOPMENT PROGRAM AREA, TO PEDRO (PETE) RODRIGUEZ, AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY DEED TO PEDRO (PETE) RODRIGUEZ. I WHEREAS, the City of San Marcos, Texas advertised for bids for the sale of that certain real property known as Parcel No. 9-1, and described more fUlly on Exhibit "A" attached hereto, located within the Tex. A-6, Neighborhood Development Program area, in the San. MancossRecord,aallocal newspaper with a general circula- tion within the County of Hays, State of Texas; and WHEREAS, pursuant to said advertisement a bid was submitted by Pedro (Pete) Rodriguez for said Parcel No. 9-1; and WHEREAS, the said bid met the minimum disposition price set upon said property by the Board of Commissioners of the Urban Renewal Agency of the City of San Marcos, Texas; and. WHEREAS, the said Board accepted the bid as the highest and best responsible bi.d for said property by a Resolution duly passed on November 9, 1976, after the b:Ld opening of November 9, 1976; and WHEREAS, said Resolution also approved the terms and conditions for the sale of the said property and recommended the approval of said purchase price and the approval of the terms and conditions for the sale, as contained in the bid docu- ments, by the City Council of the City of San Marcos, Texas; and I WHEREAS, the aforementioned bid and proposed use set forth in said bid and the sales terms and conditons pertinent thereto conform to the Redevelopment Plan for the development of the City as a whole; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: Section 1. That the terms and conditions of the sale by the City of San Marcos, Texas of Parcel No. 9-1 within the Tex. A-6, Neighborhood Development Program area, and more fully described on Exhibit J:A" attached hereto to Pedro (Pete) Rodriguez are hereby approved. Section 2. That the consideration for the sale for said property being $13,347.50 for 40,447 s<J.uare feet is hereby approved. Section 3. That the sale by the City of San Marcos is made ~ubject to restrictions of the Redevelopment Plan for the Tex. A-6, Neighborhood Development Program, as approved and amended, said plan is on file and is available for inspection in the Office of the Director of Community Development of the City of San Marcos, Section 4. That the conditions of the disposition documents, including the Deed and Contract of Sale for Private Redevelopment, are on file and are available for inspection in the Office of the Director of Community Development of the City of San Marcos. Section 5. That the purchaser is hereby placed on notice that the subject property is subject to assessment- under the provisions of Article 1105b of the Revised Civil Statutes of the State of Texas. I Section 6. That the Mayor of the City of San Marcos is hereby authorized to execute a warranty deed to Pedro (Pete) Rodriguez, from the City of San Marcos, for all that real property known as Parcel No. 9-1, located within the Tex. A-6, Neighborhood Development Program, and described more fully on Exhibit "A" attached hereto.
