<br />196 <br /> <br />ORDINANCE NO. 1977 - 6 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ABANDONING AND VACATING AN EASEMENT BETWEEN LOTS 2 <br />AND 3,AUTHORIZING THE MAYOR TO EXECUTE AND DELIVER A QUITCLAII1 <br />DEED RELINQUISHING ALL THE CITY'S RIGHT, TITLE, AND INTEREST <br />TO SAID PROPERTY TO JIM CAUTHORN, AND DECLARING AN EMERGENCY. <br /> <br />I <br /> <br />WHEREAS, the City of San Marcos has proposed to relocate the waterwiliinE line <br />serving an area of Unit 7 of Spring Lake Hills Estates, a subdivision in the <br />City of San Marcos; and <br /> <br />WHEREAS, this relocation would make an existing unused utility easement, located <br />along and between Lots 2 and 3 of SpringiLakes Hills Estates Unit 7, a subdivision <br />in the City of San Marcos, unnecessary and superfluous; and <br /> <br />WHEREAS, the City Council believes that the best interests of the public would be <br />served by the abandoning and vacating of said easement, and the quitclaiming of all <br />the City's right, title, and interest in same to Jim Cauthorn; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section I. That the public utility easement located between Lots 2 and 3 of Spring <br />Lake Hills Estates Unit 7, a subdivision in the City of San Marcos, Hays County, <br />Texas, as recorded in Book 1, Page 125 of the Plat Records of Hays County, Texas, <br />and being more particularly described by metes and bounds as follows: <br /> <br />Being a ten (10) foot wide public utilit ent, five (5) feet on <br />either side of the common lot lin ots 2 and 3 of Spring Lake <br />Hills Estates Unit 7, a subd' sion in the Ci~y of San Marcos, Hays <br />County, Texas, and being recorded in Volume 1, Page l25 of the Plat <br />Records of Hays County, Texas. <br /> <br />I <br /> <br />Section II. That the Mayor of the City of San Marcos, Dr. Emmie Craddock, or her <br />successor, be, and is, hereby authorized to execute and deliver a quitclaim deed <br />relinquishing all the City's right, title, and interest to said property to Jim <br />Cauthorn. <br /> <br />Section III.
