<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS, ABANDONING AND VACATING AN EASEMENT ALONG THE REAR
<br />OF LOT 7, AUTHORIZING THE MAYOR TO EXECUTE AND DELIVER A
<br />QUITCLAIM DEED RELINQUISHING ALL THE CITY'S RIGHT, TITLE, AND
<br />INTEREST TO SAID PROPERTY TO BEN McCOLLUM AND DECLARING AN
<br />EMERGENCY.

<br />WHEREAS, the City of San Marcos has proposed to relocate the wastewater line
<br />serving an area of Unit 7 of SpringiLake Hills Estates, a subdivision in the
<br />City of San Marcos; and
<br />
<br />WHEREAS, this ,relocation would render an existing unused utility easement, located
<br />along the rear or'Lot 7 of Spring Lake Hills Estates Unit 7, a subdivision of the
<br />City of San Marcos, unnecessary and superfluous; and
<br />
<br />WHEREAS, the City Council believes that the best interests of the public would be
<br />served by the abandoning and vacating of said easement, and the quitclaiming of all
<br />the City's right, title, and interest in same to the adjacent landowner, Ben
<br />McCollum; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:

<br />Section I. That the public utility easement containing 805 square feet of land
<br />located along the rear of Lot 7 of Bpring Lake Hills Estates Unit 7, a subdivision
<br />in the City of San Marcos, Hays County, Texas, asdrecorgedain Jjookii!:l.lRagll l25 of the
<br />Ri!:atriecorQs oftHaysnCounty~sTexas0,landsbeing more particularly described by metes
<br />and bounds as follows:
<br />BEGINNING at the most northerly northeast corner of said Lot 7 of the
<br />above mentioned subdivision, same being also the most easterly southeaE;t
<br />corner of Lot 6 of the Spring Lake Hills Estates Unit 5, a subdivision in
<br />the City of San Marcos, Hays County, Texas, as recorded in Book 1, Page
<br />27 of' 'the Plat Records of Hays County, Texas, be!ingeal1!!omarpo~nttinuthe1yeBt
<br />id:ghtibt!dway line of Alta Vista Drive for the northeast corner and place of
<br />beginning hereof.

<br />THENCE with the west right of way line of Alta Vista Drive, same being also
<br />the east line of the herein described tract of land S 29042'E for a distance
<br />of 7.98 feet to a point for the southeast corner hereof.

<br />THENCE with the south line of theloherein described tract of land S 420:24 'w
<br />for a distance of l09.02 feet to a point, said point being in the west line
<br />of Lot 7 and the East line of Lot 8 of Spring Lake Hills Estates Unit '7 for
<br />the southwest corner hereof.

<br />THENCE with the west line of Lot 7 and the east line of Lot 8 of Spring Lake
<br />Hills Bstates Unit 7 same being also the west line of the herein described
<br />tract of land N 10038'W for a distance of 9.65 feet to a point, said point
<br />being the northeast corner of Lot 8, same being also the northwest corner of
<br />Lot 7 of Spring Lake Hills Estates Unit 7, said point being also in the south
<br />line of Lot 6 of Spring Lake Hills Estates, Unit 5, for the northwest corner
<br />hereof.

<br />THENCE with the south line of Lot 6 of Spring Lake Hills Estates Unit 5, same
<br />being also the north line of Lot ~eofi8pring Lake Hills Estates Unit 7 being
<br />also the north line of the herein described tract of land, Nl~40024'E for a
<br />distance of l05.67 feet to the place of beginning and containing 805 E;quare
<br />feet of land more or less.

<br />Section II. That the Mayor of the City of San Marcos, Dr. Emmie Craddock, or her
<br />successor, be, and is, hereby autho"ized to execute and deliver a quitclaim deed
<br />relinquishing all the City!'s right, title, and interest to said property to
<br />Ben McCollum.
