<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS, TEXAS, ABANDONING AND VACATING AN
<br />EASEMENT ALONG THE REAR OF LOT 8, AUTHORIZING THE
<br />MAYOR TO EXECUTE AND DELIVER A QUITCLAIM DEED
<br />RELINQUISHING ALL THE CITY'S RIGHT, TITLE, END
<br />INTEREST TO SAID PROPERTY TO C.E. DOYLE, AND
<br />DECLARING AN lEMERGENCY.

<br />WHEREAS, the City of San Marcos has proposed to relocate the waste-
<br />water line serving an area of Unit 7 of Spring Lake Hills Estates..
<br />a subdivision in the City of San Marcos, and
<br />
<br />WHEREAS, this relocation would render an existing un~sed utility
<br />easement, located along the rear of Lot 8 of Spring Lake Hills Es1:ates
<br />Unit 7, a subdivision in the City of San Marcos, unnecessary and super-
<br />fluous; and '
<br />
<br />WHEREAS, the City Council believes that the best interests of the
<br />public would be served by the abandoning and, vacating of said easement,
<br />and the quitclaiming of all the City's right, title, and interest in
<br />same to the adjacent land owner, C.E. Doyle; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEX.!\.S:
<br />
<br />Section 1. That the public utility easement containing 528 square feet
<br />of land located along the rear of Lot 8 of Spring Lake Hills Estates
<br />Unit 7, a subdivision in the City of San Marcos, Hays County, Texas,
<br />as recorded in Bmok I, Page 125 of the Plat Records of Hays County,
<br />Texas, and being more particularly described by metes and bounds as
<br />follows:

<br />BEGINNING at the most northerly northeast corner of the above
<br />described tract of land, same being also a common corner of the
<br />northeast corner of Lot 8 and the northwest corner of Lot 7,
<br />of the above mentioned subdivision being also a point in the south
<br />line of Lot 6 of Spring Lake Hills Estates Unit 5, a subdivision
<br />in the City of San Marcos, Hays County, Texas as recorded in
<br />Book 1, Page 27 of the Plat Records of Hays County, Texas for the
<br />northeast corner and place of beginning hereof.

<br />THENCE with the common line of Lot 7 and Lot 8 of Spring Lake
<br />Hills Estates Unit 7, same being also the east line of the
<br />herein described tract of land S 10~. 38'E for a distance of
<br />9.65 feet to a point for the southeast corner hereof.

<br />THENCE with a south line of the herein described tract of land
<br />S 400 24'W for a distance of ~5.9~ feet to a point for the
<br />southwest corner hereof.

<br />THENCE with the west line of the herein described tract of :Land
<br />N 730 13'W for a distance of 8.l9 feet to a point, said point
<br />being a') inside lot corner of Lot 8 of Spring Lake Hills Estates
<br />Unit 7, being also the most southerly lot corner of Lot 6 of
<br />Spring Lake Hills Estates Unit 5 for the northwest corner hereof.

<br />Section 2. That the Mayor of the City of San Marcos, Dr. Emmie Craddock,
<br />of her successor, De, and is, hereby authorized to execute and deliver
<br />a quitclaim deed relinquishing all the City's right, title, and interest
<br />to said property to C.E. Doyle.
