<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS APPROVING THE PRICE AND TERMS AND CONDITIONS OF THE
<br />SALE BY THE CrTY OF SAN'MARCOS, TEXAS OF PARCEL NO. l3A-9
<br />AND PARCEL NO. l3A-lO, IDCATED WITHIN THE TEX. A-6, NEIGHBOR-
<br />HOOD DEVELOPMENT PROGRAM AREA, TO EVA RODRIGUEZ, AUTHORIZING
<br />THE MAYOR TO EXECUTE A WARRANTY DEED TO EVA RODRIGUEZ, AND
<br />DECLARING AN EMERGENCY.
<br />
<br />WHEREAS, the City of San Marcos, Texas advertised for bids for the sale of that
<br />certain real property known as Parcel No. lJA-9 and'Parcel No. l3A-lO, and described
<br />more fully as Lots 12 and 13 of the J .Q. Cliett Addition of the City of San Mar~os,
<br />Texas, located within the Tex. A-6, Neighborhood Development Program area, in the
<br />San Marcos Record, a local newspaper with a general circulation within the County of
<br />Hays, State of Texas; and
<br />
<br />WHEREAS, pursuant to said advertisement, a bid was submitted by Eva Rodriguez for said
<br />Parcels No. l3A-9 and l3A-10; and
<br />
<br />WHEREAS, the said bid met the mlnlmum disposition price set upon said property by the
<br />Board of Commissioners of the Urban Renewal Agency of the City of San Marcos, Texas;
<br />and
<br />
<br />WHEREAS, the said Board accepted the bid as the highest and best responsible bid for
<br />said property by a Resolution duly passed on April 12, 1977, after the bid opening of
<br />April 12, 1977; and
<br />
<br />WHEREAS, said Resolution also approved the terms and conditions for the sale of the
<br />said property and recommended the approval of said purchase price and the approval of
<br />the terms and conditions for the sale, as contained in the bid documents, by the City
<br />Council of the City of San Marcos, Texas; and
<br />
<br />WHEREAS, the aforementioned bid and proposed use set forth in said bid and the sales
<br />terms and conditions pertinent thereto conform to the Redevelopment Plan for the
<br />Tex. A-6, Neighborhood Development Program, and conform to the Plan for, the development
<br />of the City as a whole; now, therefore,

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITYCOFSS.A:N.MARCOS, TT~XAS:

<br />Section 1. That the terms and conditions of the sale by the City of San Marcos,
<br />Texas of Parcels No. l3A-9 and l3A-lO, within the Tex. A-6, Neighborhood Development
<br />Program area, and more fully described as Lots 12 and 13 of the J.Q. Cliett Addition
<br />to the City of San Marcos, Texas, to Eva Rodriguez are hereby approved.
<br />
<br />Section 2. That the consideration for the sale for said property being $3,500.00 for
<br />9,000 square feet is hereby approved.
<br />
<br />Section 3. That the sale by the City of San Marcos is made subject to restrictions
<br />of the Redevelopment Plan for the Tex. A-6, Neighborhood Development Program, as
<br />approved and amended; said Plan is on file and is available for inspection in the
<br />Office of the Director of Community Development of the City of San Marcos.

<br />Section 4. That the conditions of the disposition documents, including the Deed and
<br />Contract of Sale for Private Redevelopment, are on file and are available for inspectior
<br />in the Office of the Director of Community Development of the City of San Marcos.
<br />
<br />Section 5. That the purchaser is hereby placed on notice that the subject property
<br />is subject to assessment under the provisions of Article 1105b of the Revised Civil
<br />Statutes of the State of Texas.

<br />Section 6. That the Mayor of the City of San Marcos is hereby authorized to execute
<br />a warranty deed to Eva Rodriguez, from the City of San Marcos, for all that real properi
<br />known as Parcels No. l3A-9 and l3A-lO, located within the Tex. A-6, Neighborhood Develo]
<br />ment Program, and described more fully as Lots 12 and 13 of the J.Q. Cliett Addition to
<br />the City of San Marcos, Texas.
