<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS APPROVING TilE PRICE AND TERMS AND CONDITIONS OF THE
<br />SALE BY THE CITY OF SAN MARCOS, TEXAS OF PARCEL NO. lD-lA"
<br />DESCRIBED FURTHER ON EXHIBIT "A" ATTACHED HERETO, LOCATED
<br />WITHIN THE TEX. A-6, NEIGHBORHOOD DEVELOPMENT PROGRAM AREA,
<br />TO M~RGAN FUSCHAK, AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY
<br />DEED TO MORGAN FUSCHAK.

<br />WHEREAS, the City of San Marcos, Texas advertised for bids for the sale' of that
<br />certain real property known as Parcel lO-lA, and described more fully on Exhibit HA"
<br />attached hereto, located within the Tex. A-6, Neighborhood Development Program a.rea,
<br />in the San Marcos Record, a local newspaper with a general circulation within the
<br />County of Hays, State of Texas; and
<br />
<br />WHEREAS, pursuant to said advertisement a bid was submitted by Morgan Fuschak for
<br />said Parcel No. 10-lA; and
<br />
<br />WHEREAS, the said bid met the minimum disposition price set upon said property by
<br />the Board of Commissioners of the Urban Renewal Agency of the City of San Marcos,
<br />Texas; and
<br />
<br />WHEREAS, the said Board accepted the bid as the highest and best responsible bid for
<br />said property by a Resolution duly passed on April 12,1977, after the bid opening of
<br />April 12, 1977; and
<br />
<br />WHEREAS, said Resolution also approved the terms and conditions for the sale of the
<br />said property and recommended the approval of said purchase price and the approval
<br />of the terms and conditions for the sale, as contained in the bid documents, bJ' the
<br />City Council of the Ci~y of San Marcos, Texas; and
<br />
<br />WHEREAS, the aforementioned bid and proposed use set forth in said bid and the sales
<br />terms and conditions pertinent thereto conform to the Redevelopment Plan for the
<br />development of the City as a whole; now, therefore,

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />Section 1. That the terms and conditions of the sale by the City of San Marcos,
<br />Texas of Parcel No. 10-lA within the Tex. A-6 Neighborhood Development Program area,
<br />and more fully described on Exhibit A attached hereto to Morgan Fuschak are hereby
<br />approved.
<br />
<br />Section 2. That the consideration for the sale for said property being $28,000.00 for
<br />21F,.44r:.17 square feet' is hereby approved.
<br />
<br />Section 3. That the sale by the City of San Marcos is made subject to restrictions
<br />of the Redevelopment Plan for the Tex. A-6, Neighborhood Development, as approved and
<br />amended, said plan is on file and is available for inspection in the Office of the
<br />Director of Community Development of the City of San Marcos.

<br />Section 4. That the conditions of the disposition documents, including the Deed and
<br />Contract of Sale for Private Redevelopment, are on file and are available for inspectioJ
<br />in the Office of the Director of Community Development of the City of San Marcos.
<br />
<br />Section 5. That the purchaser is hereby placed on notice that the subject property
<br />is subject to assessment under the provisions of Article 1105b of the Revised Civil
<br />Statutes of the State of Texas.

<br />Section 6. That the Mayor of the City of San Marcos is hereby authorized to execute
<br />a warranty deed to Morgan Fuschak, from the City of San Marcos, for all that real
<br />property known as Parcel No. 10-lA, located within the Tex. A-6, Neighborhbod, Developmc
<br />Program, and described more fully on Exhibit "A" attached hereto.
<br />
<br />Section 7. That this Ordinance shall be in effect ten days from and after its
<br />passage and publication in a newspaper of general circulation in the area.
