191 <br />ORDINANCE NO. 1976-6 <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, <br />REPEALING THAT CERTAIN ORDINANCE ENACTED JANUARY <br />12, 1976, DECLARING A MORATORIUM ON THE ISSUANCE <br />OF BUILDING PERMITS FOR RESIDENTIAL MODULAR <br />CONSTRUCTION FOR A PERIOD OF SIXTY (60) DAYS, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the petition of residents of the City, the City Council <br />heard the complaints against residential modular construction; and, <br />WHEREAS, the City Council declared a moratorium on the issuance of building <br />permits for residential modular construction, said moratorium to extend to <br />March 12, 1976, so as to evaluate and consider regulation of modular <br />construction; and, <br />WHEREAS, the City Council has received its report concerning regulation and <br />finds that no immediate regulation is forthcoming; now, therefore, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />SECTION 1. That that certain ordinance adopted January 12, 1976, on an <br />emergency basis suspending the issuance of building permits for residential <br />modular construction be, and is hereby, in all things repealed so as to be <br />of no further force and effect. <br />SECTION 2. That due to the nature of this Ordinance in restoring the terms <br />and provisions of the building code as applied to modular construction in <br />providing for the orderly development of the community, an emergency is <br />declared, and the provisions of the Charter requiring that ordinances shall <br />be read on three several occasions, and that no ordinance shall become <br />effective until the expiration of ten (10) days following the date of its final <br />passage is hereby dispensed with, this ordinance to be in effect immediately <br />upon its passage by this body. <br />PASSED, APPROVED AND ADOPTED this 26 y of January, 1976. <br />i Emmie Craddock <br />Mayor <br />ATTEST: <br />I <br />Dori" Ss brick <br />City Secretary <br />AP ROVED- <br />Tom Akins <br />City Attorney
