174 <br />ORDINANCE NO. 1976-3 <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, <br />DECLARING A MORATORIUM UPON THE CONSTRUCTION <br />AND LOCATION OF MODULAR HOUSING WITHIN THE CITY <br />"at' BY SUSPENDING THE ISSUANCE OF BUILDING PERMITS <br />FOR MODULAR HOUSING FOR A PERIOD OF 60 DAYS; <br />k.^ AND DECLARING AN EMERGENCY. <br />WHEREAS, the City Council has received in excess of 300 complaints concerning <br />the placement of modular housing in San Marcos; and, <br />WHEREAS, the City Council desires to investigate and analyze the arguments of <br />proponents and opponents of modular housing; and, <br />WHEREAS, pursuant to the interest of the health, safety and welfare of the <br />citizens, the City Council wishes to defer continued use of modular housing <br />in San Marcos until the issues can be identified and resolved; now, therefore, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />SECTION 1. That a moratorium be, and is hereby declared on the issuance of <br />building permits pursuant to the Building Code of said City for residential <br />modular housing for a period of sixty (60) days from and after the final passage <br />of this Ordinance. <br />SECTION 2. For the purpose of this Ordinance, modular housing shall be defined <br />as a structure manufactured and assembled, in whose or in part, at a factory for <br />the purpose of transporting same to a site for permanent location and completion. <br />SECTION 3• Due to the imperative necessity to protect the health, safety, and <br />welfare of the citizens and residential meighborhoods of the City and the need to <br />evaluate modular housing under the Building Code of the City and to prevent <br />x' the possibility of irreparable harm to the citizens and neighborhoods, an <br />emergency is declared, and the provisions of the Charter, requiring that ordinances <br />shall be read on three several occasions, and that no ordinance shall become <br />effective until the expiration of ten (10) days following the date of its final <br />..' passage is hereby dispensed with, this Ordinance to be in effect immediately <br />upon its passage by this body. <br />PASSED, APPROVED AND ADOPTED this <br />ATTEST: ' <br />KDoriss Ham rick <br />Secretary <br />1 Tom Akins <br />City Attorney <br />12th df January, 1976. <br />?J <br />Emmie Craddock <br />Mayor <br />Published in the HAYS COUNTY CITIZEN January 15, 1976.
