<br />AN ORDINANCE APPROVING THE PRICE AND
<br />CONDITIONS OF THE SALE BY THE URBAN
<br />RENEWAL AGENCY OF THE CITY OF SAN
<br />MARCOS, TEXAS, OF PART OF PARCEL
<br />NO. 10-1 (SEE LEGAL READING), LOCA-
<br />TED WITHIN THE JUAN VERAMENDI, PROJECT
<br />N.D.P., TEX. A-6, TO RODNEY BAUGHN,
<br />SOLE PROPRIETOR, AND DECLARING AN
<br />EMERGENCY.
<br />WHEREAS, the Urban Renewal Agency of the City of San Marcos,
<br />Texas, advertised for bids for the sale of certain property avail-
<br />able for disposition within its Juan Veramendi Urban Renewal Pro-
<br />ject N.D.P., Tex. A-6, in the San Marcos Record, a local newspaper
<br />with a general circulation within the City of San Marcos, Hays
<br />County, Texas; and,
<br />WHEREAS, pursuant to said advertisement there was a bid sub-
<br />mitted by Rodney Baughn for part of Parcel No. 10-1 within said
<br />project; and,
<br />WHEREAS, the said bid met the minimum disposition price set
<br />upon said property by the Agency; and,
<br />WHEREAS, said bid was accepted by the Board of Commissioners
<br />of the Urban Renewal Agency of the City of San Marcos, Texas,
<br />after the bid opening of December 1, 1975, and by a Resolution
<br />duly passed on December 1, 1975, and whereas said Resolution
<br />authorizes sale to Rodney Baughn, and recommended the acceptance
<br />and approval of the terms and conditions of the sale to the City
<br />Council; and,
<br />WHEREAS, the aforementioned bid and proposed use set forth in
<br />said bid and its terms and conditions conform to the Redevelopment
<br />Plan for the Juan Veramendi Project, N.D.P., Tex. A-6, and conform
<br />to the plan for the development of the City as a whole.
<br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS:
<br />PART 1: That the
<br />Urban Renewal Agency o
<br />Parcel No. 10-1 within
<br />A-6, to Rodney Baughn,
<br />Section 11, of Article
<br />of Texas.
<br />price and conditions of the sale of the
<br />f the City of San Marcos, Texas, of part of
<br />the Juan Veramendi Project, N.D.P., Tex.
<br />are hereby approved in accordance with
<br />12691-3, Vernon's Annotated Civil Statutes
<br />PART 2: That the property to be sold as authorized in para-
<br />graph 1 above is more particularly described by field notes attached
<br />hereto and marked as Exhibit "A" of this Ordinance.
<br />PART 3: That the consideration for said sale being $15,000.00
<br />for 20,700 square feet is also hereby approved.
<br />PART 4: That the sale by the Urban Renewal Agency is made
<br />subject to the restriction of the Redevelopment Plan for the Juan
<br />Veramendi Project N.D.P., Tex. A-6, as approved and amended and on
<br />file in the office of the City Secretary.
<br />PART 5: That the purchaser is hereby placed on notice that the
<br />subject property is subject to assessment under the provisions of
<br />Art. 1105b of the Revised Civil Statutes of Texas, now and as
<br />hereafter amended.
