<br />AN ORDINANCE APPROVING THE PRICE AND CONDITIONS OF
<br />THE SALE BY THE URBAN RENEWAL AGENCY OF THE CITY OF
<br />SAN MARCOS, TEXAS, OF PARCEL NO. 13D-2 (SEE LEGAL
<br />READING), LOCATED WITlITN THE JUAN VERAMENDI PROJECT,
<br />N.D.P., TEX. A-G, TO JOSE S. CRUZ, AND DECLARING AN
<br />EMERGENCY.
<br />
<br />WHEREAS, the Urban Renewal Agency of the City of San Marcos, Texas, advertised
<br />for bids for the sale of certain property available for disposition within its
<br />Juan Veramendi Urban Renewal Project, N.D.P., Tex. A-6, in the San Marcos Record,
<br />a local newspaper with a general circulation within the City of San Marcos,
<br />Hays County, Texas; and
<br />

<br />WHEREAS, pursuant to said advertisement there was a bid submitted by Jose S. Cruz
<br />for all of Parcel No. 13D-2 within said project; and
<br />
<br />WHEREAS, the said bid met the minimum disposition price set upon said property by
<br />the Agency; andc
<br />
<br />WHEREAS, said bid was accepted by the Board of Commissioners of the Urban Renewal
<br />Agency of the City of San Marcos, Texas, after the bid opening of February 2, 1976,
<br />and by a Resolution duly passed on February 2, 1976; and
<br />
<br />WHEREAS, said Resolution authorizes sale to Jose S. Cruz and recommends tbe acceptance
<br />and approval of the terms and conditions of the sale to the City Council; and
<br />
<br />WHEREAS, the aforementioned bid and proposed use set forth in said bid and its terms
<br />and conditions conform to the Redevelopment Plan for the Juan Veramendi Project,
<br />N.D.P., Tex. A-6, and conform to the plan for the development of the City as a
<br />whole; now, therefore,

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:

<br />1. That the price and conditions of the sale by the Urban Renewal Agency of the
<br />City of San Marcos, Texas, of Parcel No. 13D-2 within the Juan Veramendi Project,
<br />N.D.P. Tex. A-6, to Jose S. Cruz be, and is hereby, approved in accordance
<br />with Section 11 of Article 12691-3,. Vernon's Annotated Civil Statutes of Texas.
<br />
<br />2. That the property sold as authorized in paragraph 1 above is more particularly
<br />described by field notes attached hereto and marked as Exhibit "An of this
<br />Ordinance.
<br />
<br />3. That the consideration for said sale shall be a total amount of $2,600.00 and
<br />said amount is also hereby approved.
<br />
<br />4. That the sale by the Urban Renewal Agency is made subject to the restriction of
<br />the Redevelopment Plan for the Juan Veramendi Project, N.D.P., Tex. A-6, as
<br />approved and amended and on file in the office of the Director of Community
<br />Development.
<br />
<br />5. That the condition of the disposition documents, including the Deed and Contract
<br />for Sale of Land for Private Redevelopment is on file in the office of the
<br />Director of Community Development.
<br />
<br />6. That the importance of this Ordinance creates an emergency and an imperative
<br />purpose necessary that the provision of the Charter requiring that all Ordinances
<br />be read at three separate meetings and that no Ordinance shall become effective
<br />until the expiration of ten (io) days following the date of its final passage,
<br />be suspended, and this provision is hereby suspended, and this Ordinance shall
<br />take effect and be in force from and after its adoption, and publication in a
<br />newspaper of general publication within the City.
