<br />214 <br /> <br />ORDINANCE 1976-12 <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, APPROVING <br />AND ADOPTING AMENDMENT NO. 3 TO THE URBAN RENEWAL PLAN <br />FOR N.D.P. PROJECT TEX. A-6, FINAL ACTION YEAR, AND <br />DIRECTING THAT SAID CHANGE BE FILED AS PART OF THE URBAN <br />RENEWAL PLAN FOR SAID PROJECT. <br /> <br />WHEREAS, the City has adopted a Redevelopment Plan known as the Urban Renewal <br />Plan for N.D.P. Project Tex. A-6, Final Action Year; and <br /> <br />I <br /> <br />WHEREAS, the Urban Renewal Agency has now proposed Amendment No. 3 to said Plan <br />for the purpose of effectuating a change in land use concerning an irregular <br />shaped portion of land located in the project boundaries bounded on the North <br />by Mariposa Street and on the South by Willow Springs Creek, from Multi-Family <br />Use to Park Use; and <br /> <br />WHEREAS, said Amendment No.3 has been submitted to and approved by the Board of <br />Commissioners of the Urban Renewal Agency of the City of San Marcos, Texas, by <br />Resolution dated October 6, 1975; and <br /> <br />WHEREAS, in addition said Amendment No. 3 has been submitted to the Planning and <br />Zoning Commission of the City of San Marcos and received its favorable recommendation <br />and said recommendation has been forwarded to this body; and <br /> <br />WHEREAS, said Plan, as amended, will conform to the general plan for redevelopment <br />of the City as a whole; and <br /> <br />WHEREAS, the provisions of the Texas Urban Renewal Law, Article 1269L-3, Section 7e <br />of the Vernon's Annotated Civil Statutes of Texas regarding modifications in <br />Urban Renewal plans have been complied with; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />I <br /> <br />SECTION 1. That Amendment No. 3 consisting of 1 page of textual material and <br />and amended exhibit Land Use Map 3A and accompanying survey changing the land <br />use as depicted therein of an irregular shaped tract of land from Multi-Family <br />Use to Park Use, all a part of the Urban Renewal Plan for N.D.P. Project Tex. A-6, <br />is hereby ratified, adopted and approved. <br /> <br />SECTION 2. That Amendment No. 3 is attached hereto and made a part hereof. <br /> <br />SECTION 3. That the City Secretary is hereby directed to maintain a copy of said <br />Amendment No. 3 on file in her records as public notice of the change in the <br />Redevelopment Plan for N.D.P. Project Tex. A-6, Final Action Year, and said <br />Amendment shall be binding on all redevelopers within the said project area. <br /> <br />SECTION 4.
