214 ORDINANCE 1976-12 AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AND ADOPTING AMENDMENT NO. 3 TO THE URBAN RENEWAL PLAN FOR N.D.P. PROJECT TEX. A-6, FINAL ACTION YEAR, AND DIRECTING THAT SAID CHANGE BE FILED AS PART OF THE URBAN RENEWAL PLAN FOR SAID PROJECT. WHEREAS, the City has adopted a Redevelopment Plan known as the Urban Renewal Plan for N.D.P. Project Tex. A-6, Final Action Year; and I WHEREAS, the Urban Renewal Agency has now proposed Amendment No. 3 to said Plan for the purpose of effectuating a change in land use concerning an irregular shaped portion of land located in the project boundaries bounded on the North by Mariposa Street and on the South by Willow Springs Creek, from Multi-Family Use to Park Use; and WHEREAS, said Amendment No.3 has been submitted to and approved by the Board of Commissioners of the Urban Renewal Agency of the City of San Marcos, Texas, by Resolution dated October 6, 1975; and WHEREAS, in addition said Amendment No. 3 has been submitted to the Planning and Zoning Commission of the City of San Marcos and received its favorable recommendation and said recommendation has been forwarded to this body; and WHEREAS, said Plan, as amended, will conform to the general plan for redevelopment of the City as a whole; and WHEREAS, the provisions of the Texas Urban Renewal Law, Article 1269L-3, Section 7e of the Vernon's Annotated Civil Statutes of Texas regarding modifications in Urban Renewal plans have been complied with; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: I SECTION 1. That Amendment No. 3 consisting of 1 page of textual material and and amended exhibit Land Use Map 3A and accompanying survey changing the land use as depicted therein of an irregular shaped tract of land from Multi-Family Use to Park Use, all a part of the Urban Renewal Plan for N.D.P. Project Tex. A-6, is hereby ratified, adopted and approved. SECTION 2. That Amendment No. 3 is attached hereto and made a part hereof. SECTION 3. That the City Secretary is hereby directed to maintain a copy of said Amendment No. 3 on file in her records as public notice of the change in the Redevelopment Plan for N.D.P. Project Tex. A-6, Final Action Year, and said Amendment shall be binding on all redevelopers within the said project area. SECTION 4. That this Ordinance shall become effective on the 11th day following the date of due legal process and publication in a newspaper of general circulation in the area.
