<br />233 <br /> <br />ORDINANCE NO. 1976-13 <br /> <br />AN ORDINANCE APPROVING THE PRICE AND CONDITIONS OF <br />THE SALE BY THE URBAN, RENEWAL AGENCY OF THE CITY OF <br />SAN MARCOS, TEXAS, OF PARCEL NO. 16D-2 (SEE LEGAL <br />REAlJING), LOCATED WITHIN THE JUAN VERAMENDI PROJECT, <br />N.D.P., TEX. A-6, TO CARMEN C. MIRANDA, FEME SOLE; <br />AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the Urban Renewal Agency of the City of San Marcos, Texas, advertised <br />for bids for the sale of certain property available for disposition within its <br />Juan Veramendi Urban Renewal Project, N.D.P., Tex. A-6, in the San Marcos Record, <br />a local newspaper with a general circulation within the City of San Marcos, <br />Hays County, Texas; and, <br /> <br />I <br /> <br />WHEREAS, pursuant to said advertisement there was a bid submitted by Carmen <br />C. Miranda for all of Parcel No. l6D-2 within said project; and, <br /> <br />WHEREAS, the said bid met the minimum disposition price set upon said property <br />by the Agency; and, <br /> <br />WHEREAS, said bid was accepted by the Board of Commissioners of the Urban Renewal <br />Agency of the City of San Marcos, Texas, after the bid opening of March 1, 1976, <br />and by a Resolution duly passed on March 1, 1976; and, <br /> <br />WHEREAS, said Resolution authorizes sale to Carmen C. Miranda and recommends the <br />acceptance and approval of the terms and conditions of the sale to the City <br />Council; and, <br /> <br />WHEREAS, the forernentioned bid and proposed use set forth in said bid and its <br />terms and conditions conform to the Redevelopment Plan for the Juan Veramendi <br />Project, N.D.P., Tex. A-6, and conform to the plan for the development of the <br />City as a whole; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />I <br /> <br />1. That the price and conditions of the sale by the Urban Renewal Agency of <br />the City of San Marcos, Texas, of Parcel No. 16D-2 within the Juan Veramendi <br />Project, N.D.P., Tex. A-6, to Carmen C. Miranda is hereby approved in accordance <br />with Section 11 of Article 1269L-3, Vernon's Annotated Civil Statutes of Texas. <br /> <br />2. That the property to be sold as authorized in paragraph 1 above is more <br />particularly described by field notes attached hereto and marked as "Exhibit An <br />of this Ordinance. <br /> <br />3. The consideration for said sale being a total amount of $1,750.00 is also <br />hereby approved. <br /> <br />4. The sale by the Urban Renewal Agency is made subject to the restriction of <br />the Redevelopment Plan for the Juan Veramendi Project, N.D.P., Tex. A-6, as approved <br />and amended and on file in the office of the Director of Community Development. <br /> <br />5. The condition of the disposition documents, including the Deed and Contract <br />for Sale of Land for Private Redevelopment, a copy of which is on file'in the <br />office of the Director of Community Development. <br /> <br />6. The improtance of this Ordinance creates an emergency and an imperative purpose <br />necessary that the provision of the Charter requiring that all Ordinancesibe read <br />at three separate meetings and that no ordinance shall become effective until the <br />expiration of 10 days following the date of its final passage, be suspended, and <br />this provision is hereby suspended, and this Ordinance shall take effect and be in <br />force from and after its adoption, and publication in a newspaper of general <br />circulation within the City. <br /> <br />I <br /> <br />'''''ill.
