<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS,
<br />APPROVING THE PRICE AND CONDITIONS OF THE SALE BY THE URBAN RENEWAL
<br />AGENCY OF THE CITY OF SAN MARCOS, TEXAS, OF PARCEL NO. 13D-9 (SEE
<br />LEGAL READING), LOCATED WITHIN THE JUAN VERAMENDI PROJECT, N. D. P.
<br />TEX. A-6, TO PEDRO PINEDA AND MICAELA V. PINEDA; AND DECLARING AN
<br />EMERGENCY.
<br />
<br />WHEREAS, the Urban Renewal Agency of the City of San Marcos, Texas, advertised for
<br />bids for the sale of certain property available for disposition within its Ju.an
<br />Veramendi Urban Renewal Project N.D.P., Tex. A-6, in the San Marcos Record, a. local
<br />newspaper with a general circulation within the City of San Marcos, Hays County,
<br />Texas; and

<br />WHEREAS, pursuant to said advertisement there was a bid submitted by Pedro Pineda
<br />and Micaela V. Pineda for all of Parcel No. 13D-9 within said project; and
<br />
<br />WHEREAS, the said bid met the minimum disposition price set upon said property by
<br />the Agency; and
<br />
<br />WHEREAS, said bid was accepted by the Board of Commissioners of the Urban Renewal
<br />Agency of the City of San Marcos, Texas, after the bid opening of May 4, 1976, and
<br />by a Resolution duly passed on May 4, 1976, and whereas said Resolution authorizes
<br />sale to Pedro Pineda and Micaela V. Pineda, and recommended the acceptance and
<br />approval of the terms and conditions of the sale to the City Council; and
<br />
<br />WHEREAS, the aforementioned bid and proposed use set forth in said bid and its terms
<br />and conditions conform to the Redevelopment Plan for the Juan Veramendi Project,
<br />N.D.P., Tex. A-6, and conform to the plan for the development of the City as a
<br />whole; now, therefore,

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />PART 1. That the price and conditions of the sale by the Urban Renewal Agency of
<br />the City of San Marcos, Texas, of all of Parcel No. 13D-9 within the Juan Veramendi
<br />Project, N.D.P., Tex. A-6, to Pedro Pineda and Micaela V. Pineda, are hereb)T approved I
<br />in accordance with Section 11 of Article 1269L-3, Vernon I s Annotated Civil Statutes
<br />of Texas.

<br />PART 2. That the property to be sold as a~thorized in paragraph 1 above is more
<br />particularly described by legaI:.'!.~,,",,!"iption attaChed '.and marked as Exhibit "A" of
<br />this Ordinance.
<br />
<br />PART 3. That the consideration for said sale being $2,300.00 for 9,000 square feet
<br />is also hereby approved.
<br />
<br />PART 4. That the sale by the Urban Renewal Agency is made subject to the restrictionl
<br />of the Redevelopment Plan for the Juan Veramendi Project, N.D.P., Tex. A-6, as approv
<br />and amended and on file in the Office of the Director of Community Development.
<br />
<br />PART 5. That the purchaser is hereby placed on notice that the subject property is
<br />subject to assessment under the provisions of Article 1105b of the Revised Civil
<br />Statutes of Texas, now and as hereafter amended.
<br />
<br />PART 6. That the conditions of the disposition docwnents, including the deed and
<br />contract for sale of land for private redevelopment, a copy of which is on file
<br />in the Office of the Director of Community Development.

<br />PART 7. That the importance of this Ordinance creates an emergency and an imperativ,
<br />purpose necessary that the provisions of the Charter requiring that all Ordinances b,
<br />read at three separate meetings and that no ordinance shall become effective until t
<br />expiration of 10 days following the date of its final passage be suspended, and this,
<br />Ordinance shall take effect and be in force from and after its adoption ani publica-
<br />tion in a newspaper of general circulation in the City.
