<br />I <br /> <br />49 <br /> <br />ORDINANCE NO. 1976 - 21 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 12-12 OF THE CODE OF ORDINANCES OF <br />THE CITY,OENTITLED "PRIVATE GARBAGE COLLECTION, REMOVAL <br />AND DISPOSAL GENERALLY", BY REQUIRING COMPLIANCE WITH ARTICLE <br />6701h, R.C.S OF TEXAS IN PROVIDING FINANCIAL RESPONSIBILITY <br />FOR DAMAGE, BY REDUCING THE PERMIT FEE FROM $250 TO $25; AND <br />BY REMOVING THE WORD "TRASH" SO AS TO CAUSE SAID ORDINANCE TO <br />REGULATE ONLY THE PRIVATE HAULING OF GARBAGE AS DEFINED IN <br />CHAPTER 12 OF SAID CODE. <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, has reviewed <br />regulations controlling the private hauling of garbage in the City of San Marcos, <br />Texas, and desires to de-regulate the hauling of trash and reduce the permit fee; <br />now, therefore; <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1: Tha.t Section 12-12 of the Code of Ordinances of the City of San Karcos, <br />Texas, shall be, and is hereby, amended so as to cause said section to read a.s <br />follows: <br /> <br />Section 12-12. Private garbage collection, removal and disposal generally. <br /> <br />(a) Any person, firm, corporation, or agent, other than authorized <br />city employees, acting in behalf of the City, engaged in the removal <br />of garbage from premises, other than his own, within the city limits, <br />shall, before engaging in such work, obtain a permit to do so from the <br />tax assessor-collector of the City of San Marcos. <br /> <br />I <br /> <br />(b) Application shall be made at the office of the tax assessor-collector <br />on forms provided by the tax assessor-collector and, upon presentation of <br />evidence that the applicant maintains automobile liability insurance in an <br />amount sufficient to satisfy ,the terms of Article 7601h, R. C. S. of Texas and <br />a fee based on each vehicle so registered in a manner to conform with t:1e <br />following schedule. <br /> <br />$ ;::; .OJ . $ <br />35.00 <br /> <br />1/2 ton pickup - <br />3/4 ton pickup - <br />3/4 to 2 ton stake bed <br />2 1/2 to 5 ton stake bed <br />Compactor <br /> <br />25.00 <br />35.00 <br />50.00 <br />100.00 <br />250.00 <br /> <br />(c) The permit will be effective for the calendar year or any part <br />thereof. The person to whom a City of San Marcos garbage hauler permit <br />is issued shall have the permit number displayed upon each vehicle so <br />registered, to facilitate identification of the said vehicle. <br /> <br />(d) Any vehicle used in the removal of garbage from premises other than <br />his own within the city limits of the City of San Marcos shall be of the <br />closed body refuse hauling type with watertight seals to prevent leakae:e and <br />it shall be subject to periodic inspection by the health department to insure <br />that said vehicle is maintained in a sanitary condition. <br /> <br />(e) Every person collecting or removing garbage within the City shall <br />transport such garbage to the sanitary landfill of the City of San Marcos in <br />a covered vehicle to prevent littering of the city streets. <br /> <br />I <br /> <br />SECTION 2: That this Ordinance shall take effect ten days from and after its <br />final passage. <br /> <br />PASSED AND APPROVED on first reading April 26, 1976. <br /> <br />PASSED AND APPROVED on second reading May 10, 1976. <br /> <br />PASSED, APPROVED AND ADOnED MAY 24, 1976. <br />
