<br />56 <br /> <br />ORDINANCE NO. 1976 - 23 <br /> <br />AN ORDINANCE APPROVING THE PRICES AND CONDlTIONS <br />OF THE SALES BY THE URBAN RENEWAL AGENCY OF THE <br />CITY OF SAN MARCOS, TEXAS, OF PARCEL NO. l5D-13 <br />f\;;n OAND'\OF1"PARGELINO.315D-3 (SEE LEGAL READINGS), <br />LOCATED WITHIN THE JUAN VERAMENDI, PROJECT N.D.P., <br />TEX. A-6, TO MARY SOTO AND TO JESUS GUERRERO, AND <br />DECLARING AN EMERGENCY. <br /> <br />I <br /> <br />WHEREAS, the Urban Renewal Agency of the City of San Marcos, Texas, <br />advertised for bids. for the sale of. certain property available for <br />disposition within its Juan Veramendi Urban Renewal Project N.D.P., <br />Tex. A-6, in the San Marcos Record, a local newspaper with a general <br />circulation within the City of San Marcos, Hays County, Texas; and <br /> <br />WHEREAS, pursuant to said advertisement there were bids submitted by <br />Mary Soto and by Jesus Guerrero' for Parcel No. l5D-13 and for Parcel <br />No. l5D-3, respectively, within said project; and ' <br /> <br />WHEREAS, the said bids met the minimum disposition prices set upon <br />:said properties by the Agency; and ~ <br /> <br />WHEREAS, said bids were accepted by the Board of Commissioners of <br />the Urban Renewal Agency of the City of San Marcos, Texas, after the <br />bid opening of June 8, 1976, and by a Resolution duly passed on <br />June 8, 1976; and <br /> <br />WHEREAS, said Resolution authorized sales to Mary Soto and to Jesus <br />Guerrero, and recommendedxthe acceptance' and approval of'the tenns <br />and conditions of the sales to the City Council; and <br /> <br />WHEREAS, the aforementioned bids and proposed use set forth in. said <br />bids and the terms and conditions conform to the Redevelopment Plan <br />for the Juan Veramendi Project, N.D.P., Tex. A-6, and conform to the <br />plan for the development of' the City as a whole; <br /> <br />I <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />PART I: That the prices and conditions of. the sales by the Urban <br />Renewal Agency of the City o~ San Marcos, Texas, of all of Parcel <br />No. l5D-13 and of all of Parcel No. l5D-3 within the Juan Veramendi <br />Project N.D.P., Tex. A-6, to Mary Sot~ and to Jesus Guerrero, respectivel <br />ly, are hereby approved in accordance' wi th Section 11 of Article 1269L - 31 <br />Vernon's Annotated Civil Statutes of Texas. <br /> <br />PART 2: That the properties to be sold as authorized in paragraph 1 <br />above are more particularly described by field notes attached hereto <br />and marked as Exhibit "A" of this Ordinance. <br /> <br />I <br /> <br />PART 3: That the consideration for said sales being $1,875.00 for <br />6,391 square feet, Parcel No. l5D-13, and $1,550.00 for t,326 square <br />feet. Parcel No. l5D-3, are also hereby approved. <br /> <br />PART 4: That the sales by the Urban Renewal Agency are made subject <br />to the restriction of the Redevelopment Plan for the Juan Veramendi <br />Project N.D.P., Tex. A-6, as approved and amended and on file in the <br />Office of the Director of Community Development. <br /> <br />PART 5: That the purchasers are hereby placed on notice that the <br />subject properties are subject to assessment under the provisions of <br />Article 1105b of the Revised Civil Statutes of Texas, now and as <br />hereafter amended. <br /> <br />PART 6: That the conditions of the disposition documents, including <br />the Deeds and Contracts of Sale of Private Redevelopment, are on file <br />in the Office of the Director of Community Development. <br />
