142 ORDINANCE NO, 1975 - 1 AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, ZONING FOR TRAFFIC AND RATE OF SPEED THEREIN, ON F.M. HIGHWAY 621 IN THE CITY LIMITS OF THE CITY OF SAN MARCOS; DEFINING SPEEDING AND FIXING A PENALTY THEREFOR; DECLARING WHAT MAY BE A SUFFICIENT COMPLAINT IN PROSE- CUTIONS HEREUNDER; WITH A SAVING CLAUSE REPEALING CONFLICTING LAWS ' AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. It is hereby determined upon the basis of an Engineering and Traffic investigation that the prima facie maximum speed limit on those portions of Staples Road over which F.M. Highway 621 is routed in the City limits of San Marcos, is as hereinafter stated, which prima facie maximum speed limit shall be effective at all times and signs will be erected giving notice of the prima facie maximum speed limit so declared to-wit. SPEED ZONE F.M. Highway 621 For East Bound Traffic Beginning at Centerline Station 0+50 to Sta. 9+50, a distance of 0.170 mile, a prima facie maximum speed of 35 miles per hour. Beginning at Sta. 9+50 to Sta. 25+00, a distance of 0.294 mile, a prima facie maximum speed of 40 miles per hour. Beginning at Sta. 25+00 to the east City limit of San Marcos at Sta. 31+23, a ' distance of 0.118 mile, a prima facie maximum speed of 45 miles per hour. School Speed Zone Beginning at Sta. 12+00 to Sta. 19+00, a distance of 0.133 mile, a prima facie maximum speed limit of 30 miles per hour between the hours of 7:30 A.M. to 9:00 A.M., 11:00 A.M. to 1:00 P.M. and 2:30 P.M. to 4:00 P.M. For West Bound Traffic Beginning at East City Limits of San Marcos at Sta. 31+23 to Sta. 25+00, a distance of 0.118 mile, a prima facie maximum speed limit of 45 miles per hour. Beginning at Sta. 25+00 to Sta. 9+50, a distance of 0.294 mile, a prima facie maximum speed limit of 40 miles per hour. Beginning at Sta. 9+50 to Sta. 0+50, a distance of 0.170, a prima facie maximum speed limit of 35 miles per hour. SECTION 2. That all of the streets of this City, and all portions of any such streets, are hereby declared to be public streets and that the driving or operating of any motor vehicle on or along any portion of any street of this City at a rate of speed that is greater than the maximum rate of speed for said portion of said street, as fixe& by this Ordinance shall be guilty of a misdemeanor, which is named "The Offense of Speeding", and that the said offense is punishable by fine ' in any sum not to exceed Two Hundred Dollars ($200.00). That the use of the word "Speeding" shall be sufficient to designate the said offense, and shall mean that a motor vehicle has been driven upon a public street, at a greater rate of speed than that fixed by City Ordinance for the street and for the zone thereof, that such motor vehicle was so being driven upon, if zoned. That in prosecutions under this Ordinance, for the offense of speeding, the complaint, if in other respects sufficient in form, shall as to the portion thereof seeking to acknowledge the offense, be sufficient if it in substance alleges that the defendant did while driving a motor vehicle in said City commit the offense of "Speeding".
