<br />143 <br /> <br />ORDINANCE NO. 1975 - 2 <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, ZONING FOR TRAFFIC <br />AND RATE OF SPEED THEREIN, ON S.H. HIGHWAY 123 IN THE CITY LIMITS <br />OF THE CITY OF SAN MARCOS; DEFINING SPEEDING AND FIXING A PENALTY <br />THEREFOR} DECLARING WHAT MAY BE A SUFFICIENT COMPLAINT IN PROSE- <br />CUTIONS HEREUNDER; WITH A SAVING CLAUSE REPEALING CONFLICTING <br />LAWS AND DECLARING AN EMERGENCY. <br /> <br />I <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. It is hereby determined upon the basis of an Engineering and Traffic <br />investigation that the prima facie maximum speed limit on those portions of <br />S.H. 123 in the City limits of San Marcos, is as hereinafter stated, which prima <br />facie maximum speed limit shall be effective at all times and signs will be <br />erected giving notice of the prima facie maximum speed limit so declared to-wit. <br /> <br />SPEED ZONE <br /> <br />State Highway 123 <br /> <br />For South Bound Traffic <br /> <br />Beginning at the east curb line of the east frontage road of I.H. 35 at Sta. 7+00 <br />to 18+00, a distance of 0.258 mile, a prima facie maximum speed limit of 40 miles <br />per hour. <br /> <br />Beginning at Sta. 18+00 to 36+00, a distance of 0.34 mile, a prima facie maximum <br />speed limit of 45 miles per hour. <br /> <br />Beginning at Sta. 36+00 to Sta 50+00, a distance of 0.265 mile, a prima facie <br />maximum speed of 50 miles per hour. <br /> <br />I <br /> <br />Beginning at Sta. 50+00 to the South City Limit of San Marcos at Sta. 60+66, <br />a distance of 0.202 mile, a prima facie maximum speed limit of 55 miles per hour. <br /> <br />School Speed Zone <br /> <br />Beginning at Sta. 25+00 to Sta. 31+00, a distance of 0.114 mile, a prima facie <br />maximum speed limit of 30 miles per hour during the hours of 7:30 A.M. to 9:00 A.M., <br />11:00 A.M. to 1:00 P.M., and 2:30 P.M. to 4:00 P.M. <br /> <br />For North Bound Traffic <br /> <br />Beginning at the South City Limit of San Marcos at centerline Sta. 60+66 to <br />Sta. 50+00, a distance of 0.202 mile, a prima facie maximum speed limit of <br />55 miles per hour. <br /> <br />Beginning at Sta. 50+00 to Sta. 36+00, a distance of 0~265 mile, a prima facie <br />maximum speed limit of 50 miles per hour. <br /> <br />Beginning at Sta. 36+00 to Sta. 18+00, a distance of 0.341 mile, a prima facie <br />maximum speed limit of 45 miles per hour. <br /> <br />Beginning at Sta. 18+00 to the east curb line of the east frontage road of <br />I.H. 35 at Sta. 7+00, a distance of 0.258 mile, a prima facie maximum speed limit <br />of 40 miles per hour. <br /> <br />School Speed Zone <br /> <br />I <br /> <br />Beginning at Sta. 31+00 to Sta. 25+00, a distance of 0.114 mile, a prima facie <br />maximum speed limit of 30 miles"per hour during the hours of 7:30 A.M. ,to 9:00 A.M., <br />from 11:00 A.M. to 1:00 P.M., and from 2:30 P.M. to 4:00 P.M. <br /> <br />SECTION 2. That all of the streets of this City, and all portions of any such <br />streets, are hereby declared to be public streets and that the driving or operating <br />of any motor vehicle on or along any portion of any street of this City at a rate <br />of speed that is greater than the maximum rate of speed for said portion of said <br />street, as fixed by this Ordinance shall be guilty of a misdemeanor, which is <br />named "The Offense of Speeding", and that the said offense is punishable by fine <br />in any sum not to exceed Two Hundred Dollars ($200.00). That the use of the word <br />
