<br />152 <br /> <br />ORDINANCE NO. 1975 - 5 <br /> <br />AN ORDINANCE APPROVING THE PRICES AND CONDITIONS OF THE <br />SALE BY THE URBAN RENEWAL AGENCY OF THE CITY OF SAN MARCOS, <br />TEXAS, OF PARCEL 13D",4A, 13D-4B, 13D-5,13D-7A, 13D-7B AND <br />13D-8A (SEE LEGAL READING), LOCATED WITHIN THE JUAN VERA- <br />MENDI, PROJECT NDP, TEX. A-6, TO REYNALDO GARZ4L TONY <br />GONZALES, RAMON ORTUNIO SOLE PROPRIETORS. <br /> <br />I <br /> <br />WHEREAS, the Urban Renewal Agency of the City of San Marcos, Texas, <br />advertised for bids for the sale of certain property available for dispo- <br />sition within its Juan Veramendi Urban Renewal Project NDP, Tex. A-6, in <br />the San Marcos Record, a local newspaper with a general circulation within <br />the City of San Marcos, Hays County, Texas; and, <br /> <br />WHEREAS, pursuant to said advertisement there was a bid submitted by Reynaldo <br />Garza, Tony Gonzales and Ramon Ortunio for all of Parcels 13D-4A, l3D-4B, <br />13D-5, 13D-7A, 13D-7B and 13D-8A within said project: and, <br /> <br />WHEREAS, the said bids met the minimum disposition prices set upon said <br />properties by the Agency; and, <br /> <br />WHEREAS, said bids were accepted by the Board of Commissioners of the Urban <br />Renewal Agency of the City of San Marcos, Texas, after the bid opening of <br />November 4, 1974, and whereas said Resolution duly passed on November 4, 1974, <br />and whereas said Resolution authorizes sale to Reynaldo Garza, Tony Gonzales <br />and Ramon Ortunio and recommended the acceptance and approval of the terms <br />and conditions of the sale to the City Council; and, <br /> <br />WHEREAS, the aforementioned bids and proposed use set forth in said bids and <br />its terms and conditions conform to the Redevelopment Plan for the Juan <br />Veramendi Project, NDP, Tex. A-6, and conform to the plan for the development <br />of the City as a whole: <br /> <br />II <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, THAT: <br /> <br />1. The prices and conditions of the sales of the Urban Renewal Agency of the <br />City of San Marcos, Texas, of Parcel #13D-4A, 13D-4B, l3D-5, 13D-7A, 13D-7B <br />and 13D-8A within the Juan Veramendi Project, NDP, Tex. A-6, to Reynaldo Garza, <br />Tony Gonzales and Ramon Ortunio are hereby approved in accordance with Section <br />11, of Article 12691-3, Vernon's Annotated Civil Statutes of Texas. <br /> <br />2. The properties to be sold as authorized in paragraph 1 above are more <br />particularly described by field notes attached hereto and marked as <br />Exhibit "A" through Exhibit "F" of this Ordinance. <br /> <br />3. The consideration for said sale being a total amount of $4,825.00 is <br />also hereby approved. <br /> <br />4. The sale by the Urban Renewal Agency is made subject to the restriction <br />of the Redevelopment Plan for the Juan Veramendi Project NDP, Tex. A~6, as <br />approved and amended and on file in the office of the City Clerk. <br /> <br />5. The condition of the disposition document, including the Deed and Contract <br />for Sale of Land for Private Redevelopment, a copy of which is on file in the <br />office of the City Clerk. <br /> <br />I <br /> <br />6. This Ordinance shall become effective on the 11th day following the date of <br />due legal process and publication in a newspaper of general circulation in the area. <br /> <br />PASSED AND APPROVED on first reading December 16, 1974. <br /> <br />PASSED AND APPROVED on second reading January 13, 1975. <br /> <br />PASSED, APPROVED AND ADOPTED January 27, 1975. <br />
