180 ORDINANCE NO, 1975 - 13 I AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, REPEALING THE SUBDIVISION ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, CODIFIED AS APPENDIX C OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, AND ENACTING A NEW ORDINANCE TO BE CODIFIED AS APPENDIX C OF SAID CODE ADOPT- ING AND PROMULGATING RULES AND REGULATIONS GOVERN- ING THE PLATTING OF LAND INTO SUBDIVISIONS IN THE CITY. OF SAN MARCOS AND WITHIN THE EXTRA-TERRI- TORIAL JURISDICTION OF THE CITY OF SAN MARCOS AND REQUIRING PLATS TO CONFORM TO SUCH RULES AND REGULATIONS IN ORDER TO PROCURE THE APPROVAL OF THE CITY PLANNING AND ZONING COMMISSION OF THE CITY OF SAN MARCOSl DEFINING TERMS; FORBIDDING TRANSFERS OF LAND WITHOUT COMPLYING WITH THE TERMS OF THIS ORDINANCE 1 PROVIDING FOR VARIANCES FROM THE PROVISIONS OF THIS ORDINANCEl PROVIDING FOR THE APPEAL OF THIS ORDINANCE 1 PROVIDING PENALTIES FOR THE VIOLATION OF ANY OF THE PROVI- SIONS OF THIS ORDINANCEl PROVIDING FOR THE EF- FECTIVE DATEl AND PROVIDING FOR THE STUDY AND PASSAGE OF THE ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF. THE CITY OF SAN MARCOS, TEXAS, AS FOLLOWS: I ARTICLE I - GENERAL PROVISIONS AND REQUIREMENTS Section A. Title. This Ordinance shall be known, cited, and referred to as "The City of San Marcos Subdivision Ordinance". Section B. Authority. This Ordinance is adopted under the authority of the Constitution and laws of the 'State of Texas, including particularly Chapter 231, Acts of the 40th Legislature, Regular Session, 1927, as heretofore or hereafter amended (compiled as Article 974a, Vernon's Revised civil Statutes), and the provisions of Section 4 of the Municipal Annexation Act as heretofore or hereafter amended (compiled as Article 970a, Vernon's Revised Civil Statutes.) This Ordinance is adopted pursuant to the provisions of Section 12.10 and 7.05d of the Charter of the City. I Section C. Purpose. In order to achieve orderly, efficient, and environmentally sound subdivision of land, the City of San Marcos must be provided with appropriate guidelines and mechanisms. This Subdivision Ordinance, in conjunction with any other land use control tool as now or hereafter may be adopted by the City, provides those guidelines and mechanisms. With this in mind, it is the nature, intent, and stated purpose of this Subdivision Ordinance to: 1. Provide for the most orderly, efficient, and economical development of its resi- dential, commercial, and industrial land uses and community facilities, to include transportation, water, sewerage, drainage, schools, parks', recreation, and any other related element.
