<br />28 <br /> <br />ORDINANCE NO. 1975 -22 <br /> <br />AN ORDINANCE 01" THE CITY 01" SAN ~lARCOS, TEXAS, <br />ZONING 1"0R TRAl":F'IC AND RATE 01" SPEED THEREIN, ON <br />STATE HIGHWAY 123 IN THE CITY LIMITS 01" THE CITY <br />01" SAN BARCOS; DEFINING SPEEDING AND l"IXING A <br />PENALTY THEREFOR; DECLARING WHAT ~MY RE A SUFl"ICIENT <br />CO'lPLAINT IN PROSECUTIONS HEREUNDER; WITH A SAVING <br />CLAUSE REPEALING CONHICTING LAWS AND DECLARING AN <br />EHEP.GENCY. <br /> <br />I <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN ~lARCOS, TEXAS: <br /> <br />Section 1. It is hereby determined upon the basis of an Engineering <br />and Traffic investigation that the prima facie maximum speed limit <br />on those portions of State Highway l23 routed in the City Limits of <br />San "arcos, is as hereinafter stated, which prima facie maximum speed <br />limit shall be effective at all times and signs will be erected giving <br />notice of the prima facie maximum speed limit so declared to-wit. <br /> <br />SPEED ZONE <br />STATE HIGHWAY 123 <br /> <br />Por South Bound Traffic <br /> <br />Beginning at the east curb line of the east frontage road of I.H. 35, <br />Station 7+00, to Station 18+00, a distance of 0.208 mile, a prima facie <br />maximum speed limit of 40 miles per hour. <br /> <br />Beginning at Station 18+00 to Station 50+00, a distance of 0.606 mile, <br />a prima facie maximum speed limit of 45 miles per hour. <br /> <br />Beginning at Station 50+00 to Station 60+66, the same being the south <br />City Limit of San Marcos, a distance of 0.202 mile, a prima facie <br />maximum speed limit of 55 miles per hour. <br /> <br />I <br /> <br />School Speed 70ne <br /> <br />Beginning at Station 25+00 to Station 45+25, a distance of 0.384 mile, <br />a prima facie maximum speed limit of 30 miles per hour during the hours <br />of 7:~O A.H. to 9:'0 A.M. - from 11:00 A.M. to 1:00 P.M. and from 2:30 P.M. <br />to 4:00 P.~l. when signals are flashing. <br /> <br />For North Bound Traffic <br /> <br />Beginning at Station 60+6fi, t"e saJ11e being the south City Limit of San <br />Marcos to Station 50+00, a distance of 0.202 mile, a prima faci~ <br />maximum speed limit of 55 miles per hour. <br /> <br />Beginning at Station 50+00 to Station 18+00, a distance of 0.606 mile, <br />a prima facie maximum speed limit of 45 miles per hour. <br /> <br />Beginning at Station 18+00 to Station 7+00, a distance of 0.208 mile, a <br />prima facie maximum speed limit of 40 miles per hour. <br /> <br />I <br /> <br />School Speed 70ne <br /> <br />Beginning at Station 45+25 to Station 25+00, a distance ofGO.384 mile, <br />a prima facie maximum speed limit of 30 miles per hour during the hours <br />of 7:30 A.M. to 9:00 A.M. - from ll:OO A.M. to 1:00 P.M. and from 2:30 P.M. <br />to 4:00 P.M. when signals are flashing. <br /> <br />Section 2. That all of the streets of this City, and all portions of <br />any such streets, are hereby declared to be public streets and that the <br />driving or operating of any motor vehicle on or along any portion of <br />any street of this City at a rate of speed that is greater than the <br />maximum rate of speed for said portion of said street, as fixed by this <br />
