28 ORDINANCE NO. 1975 -22 AN ORDINANCE 01" THE CITY 01" SAN ~lARCOS, TEXAS, ZONING 1"0R TRAl":F'IC AND RATE 01" SPEED THEREIN, ON STATE HIGHWAY 123 IN THE CITY LIMITS 01" THE CITY 01" SAN BARCOS; DEFINING SPEEDING AND l"IXING A PENALTY THEREFOR; DECLARING WHAT ~MY RE A SUFl"ICIENT CO'lPLAINT IN PROSECUTIONS HEREUNDER; WITH A SAVING CLAUSE REPEALING CONHICTING LAWS AND DECLARING AN EHEP.GENCY. I BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN ~lARCOS, TEXAS: Section 1. It is hereby determined upon the basis of an Engineering and Traffic investigation that the prima facie maximum speed limit on those portions of State Highway l23 routed in the City Limits of San "arcos, is as hereinafter stated, which prima facie maximum speed limit shall be effective at all times and signs will be erected giving notice of the prima facie maximum speed limit so declared to-wit. SPEED ZONE STATE HIGHWAY 123 Por South Bound Traffic Beginning at the east curb line of the east frontage road of I.H. 35, Station 7+00, to Station 18+00, a distance of 0.208 mile, a prima facie maximum speed limit of 40 miles per hour. Beginning at Station 18+00 to Station 50+00, a distance of 0.606 mile, a prima facie maximum speed limit of 45 miles per hour. Beginning at Station 50+00 to Station 60+66, the same being the south City Limit of San Marcos, a distance of 0.202 mile, a prima facie maximum speed limit of 55 miles per hour. I School Speed 70ne Beginning at Station 25+00 to Station 45+25, a distance of 0.384 mile, a prima facie maximum speed limit of 30 miles per hour during the hours of 7:~O A.H. to 9:'0 A.M. - from 11:00 A.M. to 1:00 P.M. and from 2:30 P.M. to 4:00 P.~l. when signals are flashing. For North Bound Traffic Beginning at Station 60+6fi, t"e saJ11e being the south City Limit of San Marcos to Station 50+00, a distance of 0.202 mile, a prima faci~ maximum speed limit of 55 miles per hour. Beginning at Station 50+00 to Station 18+00, a distance of 0.606 mile, a prima facie maximum speed limit of 45 miles per hour. Beginning at Station 18+00 to Station 7+00, a distance of 0.208 mile, a prima facie maximum speed limit of 40 miles per hour. I School Speed 70ne Beginning at Station 45+25 to Station 25+00, a distance ofGO.384 mile, a prima facie maximum speed limit of 30 miles per hour during the hours of 7:30 A.M. to 9:00 A.M. - from ll:OO A.M. to 1:00 P.M. and from 2:30 P.M. to 4:00 P.M. when signals are flashing. Section 2. That all of the streets of this City, and all portions of any such streets, are hereby declared to be public streets and that the driving or operating of any motor vehicle on or along any portion of any street of this City at a rate of speed that is greater than the maximum rate of speed for said portion of said street, as fixed by this
