<br />104 <br /> <br />ORDINANCE NO. 1974 - l5 <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS DECLARING A <br />MORATORIUM UPON THE TERMS AND PROVISIONS <br />OF THAT CERTAIN ORDINANCE KNOWN AS THE <br />SUBDIVISION ORDINANCE OF THE CITY OF <br />SAN MARCOS AND CODIFIED AS APPEND IS C <br />OF THE CODE OF ORDINANCES OF THE CITY <br />OF SAN MARCOS; DELAYING THE APPROVAL OF <br />ALL PLATS, SUSPENDING ACTION UPON ALL <br />PLATS AND SUBDIVISIONS, ESTABLISHING <br />A SIX MONTH TIME LIMITATION ON SUCH <br />DECLARATION, DELAY AND SUSPENSION, AND <br />DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the City Council of the City of San Marcos, <br /> <br />Texas is contemplating the passage of a new subdivision <br /> <br />ordinance for the City of San Marcos; and, <br /> <br />WHEREAS, in the opinion of the City Council any action <br /> <br />taken upon new subdivisions within the corporate limits of <br /> <br />the City or within its jurisdiction would be detrimental to <br /> <br />the goals and ideals contained within the prospect of a new <br /> <br />subdivision ordinance; and, <br /> <br />WHEREAS, the City Council desires to maintain the status <br /> <br />I <br /> <br />quo as it relates to subdivisions under its jurisdiction; now, <br /> <br />therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> <br />SAN MARCOS, TEXAS: <br /> <br />Part 1. That a moratorium be, and is hereby, declared <br /> <br />upon that ordinance known as the Subdivision Ordinance of the <br /> <br />City of San Marcos, and codified as Appendix C to the Code <br /> <br />of Ordinances of the City of San Marcos by delaying the <br /> <br />consideration of any and all plats and suspending action upon <br /> <br />any and all plats and subdivisions by the City Councilor <br /> <br />Planning and Zoning Commission as required by the Subdivision <br /> <br />Ordinance or by Article 970(a) and Article 974(a), Texas <br /> <br />I <br /> <br />Revised Civil Statutes (1925). <br /> <br />Part 2. That the period of duration for this ordinance <br /> <br />and moratorium shall be six (6) months from and after the date <br /> <br />of passage. <br /> <br />Part 3. There being an emergency and imperative necessity <br /> <br />that this Ordinance be approved, the reading of this Ordinance <br /> <br />on three several days is hereby dispensed with and the same <br /> <br />shall be in full force and effect from and after its passage. <br />
