105 ORDINANCE NO. 1974 - 16 AN ORDINANCE I APPROVING AND ADOPTING AMENDMENT NO. 2 TO THE URBAN RENEWAL PLAN FOR N.D.P. PROJECT TEX. A-6, FOURTH ACTION YEAR, AND DIRECTING THAT SAID CHANGE BE FILED AS PART OF THE URBAN RENEWAL PLAN FOR SAID PROJECT WHEREAS, the City has adopted a Redevelopment Plan known as the Urban Renewal Plan for N.D.P. Project Tex. A-6, Fourth Action Year; and, ..". ~ lr. ~ ~ WHEREAS, the Urban Renewal Agency has now proposed Amend- ment No. 2 to said Plan for the purpose of effectuating a change in land use concerning an irregular shaped portion of land located in the project boundaries bounded on the East by C. M. Allen Parkway and on the West by Moon Street, from Public Use to General Business Use; and, WHEREAS, said Amendment No. 2 has been submitted to and approved by the Board of Commissioners of the Urban Renewal Agency of the City of San Marcos, Texas, by Resolution dated February 4, 1974; and, WHEREAS, in addition said Amendment No.2 has been ,submitted to the Planning Commission of the City of San Marcos and received its favorable recommendation and said recommendation has been forwarded to this body; and, I \ WHEREAS, said Plan, as amended, will conform to the general plan for redevelopment of the City as a whole; and, WHEREAS, the provisions of the Texas Urban Renewal Law, Article 1269L-3, Section 7e of the Vernon's Annotated Civil Statutes of Texas regarding modifications in Urban Renewal plans have been complied with. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, THAT: SECTION 1. Amendment No. 2 consisting of 1 page of textual material and an amended exhibit Land Use Map ND-401-CCC and accompanying survey changing the land use as depicted therein of an irregular shaped tract of land from Public Use to General Business Use, all a part of the Urban Renewal Plan for N.D.P. Project Tex. A-6, is hereby ratified, adopted and' approved. SECTION 2. Amendment No. 2 is attached hereto and made a part hereof. I SECTION 3. The City Clerk is hereby directed to maintain a copy of said Amendment No. 2 on file in his records as public notice of the change in the Redevelopment Plan for N.D.P. Project Tex. A-6, Fourth Action Year, and said Amendment shall be binding on all redevelopers within the said project area.
