IN THE CITY OF SAN MARCOS, TEXAS, FOR NATURAL <br />GAS AND NATURAL GAS SERVICE FURNISHED BY IT TO <br />RESIDENTIAL AND COMMERCIAL CONSUMERS, CONTAINING <br />DEFINITIONS, FIXING THE EFFECTIVE DATES OF GAS <br />RATES PRESCRIBED IN THIS ORDINANCE, MAKING MISCEL- <br />LANEOUS PROVISIONS AND REPEALING ALL ORDINANCES <br />IN CONFLICT. ' <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF' SAN 'MARCOS, TEXAS: <br /> <br />SECTION 1. That United Gas, Inc. is hereby authorized to <br />place in effect the fOllowing schedules of rates within the <br />corporate limits of the City of San Marcos, Texas (hereinafter <br />called "City") for the supply of natural gas and natural gas <br />service: <br /> <br />RESIDENTIAL RATES <br /> <br />Rate Schedule R-89-B, a copy of which <br />is attached, marked Exhibit "A", and <br />made a part hereof. <br /> <br />COMMERCIAL RATES <br /> <br />Rate Schedule SC-89-B, a copy of which <br />is attached, marked Exhibit "B", and <br />made a part hereof. <br /> <br />The above described schedule of residential rates and of <br />commercial rates are the highest rates that may be charged by <br />United Gas, Inc. for residential consumers and commercial consumers <br />within the City. other lower residential rates and commercial <br />rates may be fixed and determined from time to time by United Gas, <br />Inc. for gas and gas service furnished to residential consumers <br />and commercial consumers within the City. <br /> <br />SECTION 2. That the terms "residential consumer" and <br />"commercial consumer" as used herein shall be defined as set out <br />in said Exhibits "A" and "B", respectively. <br /> <br />SECTION 3. That natural gas supplied by United Gas, Inc. <br />is for the individual use, of the consumer at one point of delivery <br />and shall not be resold or shared with others. <br /> <br />SECTION 4. That the effective date of this ordinance shall <br />be the eleventh day following the third and final passage and <br />adoption of this ordinance. The maximum rates and charges prescribed <br />in this ordinance for residential consumers and,co):!llnercial consumers <br />shall apply as maximum rates and charges to all gas used by such <br />consumers to whom such rates are applicable after their regular <br />meter reading dates commencing on the day next following the <br />effective date of this ordinance. <br /> <br />SECTION 5. That all ordinances or parts of ordinances in <br />conflict herewith are repealed to the extent of the conflict only. <br /> <br />SECTION 6. That nothing contained in this ordinance shall be <br />construed as in any manner, now or hereafter, Limiting or modifying <br />the right and power of the City, under the law, to regulate the <br />rates charged by United Gas, Inc. within the City. <br /> <br />PASSED AND APPROVED on first reading February 26, 1973. <br /> <br />PASSED AND APPROVED on second reading March 12, 1973. <br /> <br />PASSED, APPROVED AND ADOPTED March ~6, 1973. <br /> <br /> <br />~?C~~~ <br />Luciano H.
