~--1973 -7------ --- f f I I 111I ;2.6 AN ORDINANCE DETERMINING AND FIXING THE MAXIMUM SCHEDULES OF RATES TO BE CHARGED BY UNITED GAS, INC. IN THE CITY OF SAN MARCOS, TEXAS, FOR NATURAL GAS AND NATURAL GAS SERVICE FURNISHED BY IT TO RESIDENTIAL AND COMMERCIAL CONSUMERS, CONTAINING DEFINITIONS, FIXING THE EFFECTIVE DATES OF GAS RATES PRESCRIBED IN THIS ORDINANCE, MAKING MISCEL- LANEOUS PROVISIONS AND REPEALING ALL ORDINANCES IN CONFLICT. ' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF' SAN 'MARCOS, TEXAS: SECTION 1. That United Gas, Inc. is hereby authorized to place in effect the fOllowing schedules of rates within the corporate limits of the City of San Marcos, Texas (hereinafter called "City") for the supply of natural gas and natural gas service: RESIDENTIAL RATES Rate Schedule R-89-B, a copy of which is attached, marked Exhibit "A", and made a part hereof. COMMERCIAL RATES Rate Schedule SC-89-B, a copy of which is attached, marked Exhibit "B", and made a part hereof. The above described schedule of residential rates and of commercial rates are the highest rates that may be charged by United Gas, Inc. for residential consumers and commercial consumers within the City. other lower residential rates and commercial rates may be fixed and determined from time to time by United Gas, Inc. for gas and gas service furnished to residential consumers and commercial consumers within the City. SECTION 2. That the terms "residential consumer" and "commercial consumer" as used herein shall be defined as set out in said Exhibits "A" and "B", respectively. SECTION 3. That natural gas supplied by United Gas, Inc. is for the individual use, of the consumer at one point of delivery and shall not be resold or shared with others. SECTION 4. That the effective date of this ordinance shall be the eleventh day following the third and final passage and adoption of this ordinance. The maximum rates and charges prescribed in this ordinance for residential consumers and,co):!llnercial consumers shall apply as maximum rates and charges to all gas used by such consumers to whom such rates are applicable after their regular meter reading dates commencing on the day next following the effective date of this ordinance. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. SECTION 6. That nothing contained in this ordinance shall be construed as in any manner, now or hereafter, Limiting or modifying the right and power of the City, under the law, to regulate the rates charged by United Gas, Inc. within the City.
