ORDINANCE 1981-17 <br /> <br />129 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS AMENDING SECTION 3,48, <br />ENTITLED "DISPOSITION OF UNCLAIMED ANIMALS," <br />OF THE CODE OF ORDINANCES, CITY OF SAN MARCOS, <br />TEXAS TO REQUIRE THE PAYMENT OF A FEE OF SIX <br />DOLLARS ($6.00) FOR A CERTIFICATE ENTITLING <br />THE POSSESSOR TO HAVE AN ANIMAL VACCINATED <br />FOR RABIES, SAID PAYMENT TO BE MADE BY A PER- <br />SON ADOPTING AN ANIMAL WHICH HAS BEEN IM- <br />POUNDED BY THE CITY OF SAN MARCOS, TEXAS, AND <br />DECLARING AN EMERGENCY. <br /> <br /> WHEREAS, the threat of rabies is an ever-present danger <br />to persons and animals in an urban environment; and, <br /> <br /> WHEREAS, the City of San Marcos, Texas, wishes to en- <br />courage persons to keep any animal belonging to them vaccinated <br />against rabies; now, therefore, <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION i. That section 3-48 of the Code of Ordinances, <br />City of San Marcos, Texas, is hereby amended to read as follows: <br /> <br />Sec. 3-48. Disposition of unclaimed animals. <br /> <br /> Should the owner o~ keeper of any impounded dog, <br />cow, horse, jack, jennet, sheep, goat or other <br />like animal fail to redeem same as provided under <br />this article within the seventy-two (72) hours <br />provided, then any such animal may be destroyed in <br />a manner approved by the American Humane Society. <br />At any time subsequent to expiration of the pre- <br />scribed redemption period and prior to the destruc- <br />tion of any such animal under the provisions hereof, <br />the city may sell any such animal so impounded to <br />the first person tendering to the city the pound fees <br />and license fees provided for in this chapter together <br />with the sum of six dollars ($6.00). <br /> <br /> Upon payment of said six dollars ($6.00) sum, the <br />person tendering payment shall receive a certificate <br />which shall entitle the holder to a rabies vaccina- <br />tion for the animal purchased from any participating <br />veterinarian. <br /> <br /> Veterinarians participating in this program to en- <br />courage rabies vaccinations shall turn any and all <br />said certificates into the Department of Finance of <br />the City of San Marcos on a monthly basis. Said <br />department shall promptly issue a check to each <br />participating veterinarian which shall be payment in <br />the amount of $6.00 x no. certificates s~fnit.ted. <br /> <br /> SECTION 2. That the importance of this Ordinance creates <br />an emergency and an imperative purpose necessary that the pro- <br />visions of the charter requiring that ordinances shall be read <br />at three Separate meetings and that no ordinance shall become <br />effective until the expiration of ten (10) days following the <br />date of its final passage be suspended, and these provisions <br />are hereby suspended, and this Ordinance shall take effect and <br />be in full force and effect from and after its adoption and <br />phblication in a newspaper of general circulation within the <br />City. <br /> <br />PASSED, APPROVED, AND ADOPTED this9th day of March <br /> <br />Attest: <br /> <br />Sharyl Werner <br />City Secretary <br /> <br />/ John/~J.
