<br />1973 - 17 <br /> <br />I <br /> <br />AN ORDINANCE REPEALING, TMAT @RDINANCE OF <br />NOVEMBER 9, 1970, AND OF RECORD IN VOLUME 39, <br />PAGE ~, OF THE MINUTES OF THE CITY <br />COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, WHICH <br />DECLARED AND DETERMINED THE NECESSITY FOR THE <br />IMPROVEMENT OF CERTAIN STREETS WITHIN THE CITY <br />LIMITS, APPROVED PLANS AND SPECIFICATIONS FOR <br />THE CONSTRUCTION OF SUCH IMPROVEMENTS, AND <br />RETAINED A FISCAL AGENT, SPECIAL COUNSEL AND <br />CONSULTING ENGINEER; DECLARING AN EMERGENCY AND <br />PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT <br />IMMEDIATELY UPON ITS PASSAGE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That on the 9th day of November, 1970, the City Council <br />of the City of San Marcos, Texas, duly enacted an ordinance declaring and <br />determining the necessity for the improvement and ordering the improvement <br />of certain streets or avenues or portions thereof, approving plans and <br />specifications for the construction of improvements, and retaining a fiscal <br />agent, special counsel and consulting engineer. Said ordiance is of record <br />in Vo 1 ume ---1L, page 42 , of the Minutes. of the City Counc i 1 of the <br />City of San Marcos. <br /> <br />SECTION 2. That a number of the terms andprovisions of said ordinance <br />of November 9, 1970, have never been carried into effect, and, at this date, <br />it is contemplated that they never will be. However, it is a publ ic necessity <br />that some of the terms and provisions of such ordinance be carried into <br />effect and at the earliest practicable date. <br /> <br />I <br /> <br />SECTION 3. As it is impractical to attempt to proceed under the terms <br />and provisions of said ordinance as to the portions thereof that must be <br />carried into effect, it is imperative that said ordinance be repealed in <br />full and another ordinance be enacted in substitution at,the earliest prac- <br />ticable date to take its place. <br /> <br />SECTION 4. Therefore, said ordinance of November 9, 1970, is hereby <br />repealed in full, and same shall have no further force or effect from the <br />date of the passage hereof. <br /> <br />SECTION 5. The publ ic welfare being endangered due to the fact that <br />said ordinance of November 9, 1970, no longer adequately provides for the <br />street improvement program of the City of San Marcos; therefore, an emergency <br />exists, requiring that the provisions of the Charter of the City of San <br />Marcos, Texas, which ordinarily require ordinances to be read on three (3) <br />several days and that no ordinances shall become effective until the expira- <br />tion of ten (10) days following the date of its final passage, be dispensed <br />with.
