I AN OROINANCE DECLARING AND DETERMINING THE NECESSITY FOR THE IMPROVEMENT AND ORDERING THE IMPROVEMENT OF CERTAIN STREETS AND AVENUES OR PORTIONS THEREOF OF THE CITY OF SAN MARCOS, TEXAS; APPROVING PLANS AND SPECIFICATIONS FOR SUCH WORK; AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR BIDS FOR SUCH IMPROVEMENT WORK; DIRECTING THE PREPARATION OF ENGINEERING ESTI- MATES AND THE CREATION OF AN ASSESSMENT ROLL AND CERTIFICATES OF ASSESSMENT, IN THE MANNER TO THE EXTENT AND WITHIN THE LIMITS HEREIN SET OUT; INVOKING THE POWERS AND THE PROCEDURE PROVIDED BY CHAPTER 106 OF THE ACTS OF THE FIRST CALLED SESSION OF THE 40TH LEGISLATURE OF THE STATE OF TEXAS, AS AMENDED, KNOWN AS ARTICLE l105b, VERNON'S REVISED CIVIL STATUTES OF TEXAS; PROVIDING THE MANNER IN WHICH AND BY WHOM THE COST OF SUCH IMPROVEMENTS SHALL BE PAID AND PROVIDING FOR THE ASSESSMENT OF A PORTION OF SUCH COST AGAINST ABUTTING PROPERTIES AND THE OWNERS THEREOF; PROVIDING THAT THE AMOUNTS PAYABLE BY THE ABUTTING PROPERTY OWNERS SHALL BE A PERSONAL LIABILITY SECURED BY A FIRST AIlD PRIOR LIEN UPON SUCH PROPERTIES, AS WELL AS PROVIDING FOR THE TERMS OF PAYMENT OF SUCH ASSESSMENTS; PROVIDING A SEPARABILITY CLAUSE; DIRECTING THE CITY SECRETARY TO PREPARE AND FILE A NOTICE OF THE ENACT- MENT HEREOF WITH THE COUNTY CLERK OF HAYS COUNTY, TEXAS; DECLARING AN EMERGENCY AND PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY UPON ITS PASSAGE. I BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS: SECTION 1. That there exists a pub] ic necessity to permanently improve the following named streets and avenues or portions thereof of the City of San Marcos, Texas, within the 1 imits herein defined, to-wit: UNIT ONE (STREET) Northwest of and generally parallel to Interstate Highway No. 35 and North of the C. CREWS ADDITION. (Paving width shall be 44 feet back to back of curbs, including new concrete curbs). THORP LANE, extending in a Northeasterly direction from the North Right-of- Way 1 ine State Ranch Road No. 12 to the South Right-of-Way line of State High- way Loop No. 82. UNIT TWO (STREET) parallel to and Southeast of Interstate Highway No. 35 in the J. P. ELLIS SUBDIVISION NO.2 and the ROGERS SUBDIVISION ~O. 1. (Paving width shall be 36 feet back to back of curbs, including new concrete curb). I LINDA DRIVE, extending in a Northeasterly direction from a line drawn across Linda Drive between the East corner of Lot No. 13, Block No.2 and the North corner of Lot No.5, Block No.4 of the J. P. ELLIS SUBDIVISION NO.2. for approximately 1970' to an angle and then in a Southeasterly direction to the West Right-of-Way line of Bugg Lane. BUGG LANE, extending Northward from the South Right-of-Way 1 ine of Linda Drive to the South Right-of-Way line of Highway No. 80 (Lul ing Highway). SECTION 2. Tbat it is bereby ordered that such hereinabove named streets or avenues or portions thereof within the limits hereinabove described shall be improved by grading and paving or permanently repairing or repaving the same and/or by construct- ing curbs and/or gutters, where there are no existing curbs and gutters, and where nec- essary by reconstructing and realigning existing curbs and gutters; and by widening said streets or avenues or portions thereof, where necessary, so as to attain the width above set out; and by constructing necessary and proper appurtenances and incidentals to such improvements including drains and culverts; said paving to consist of 1 ime -1- ~
