I I 1973-19-R /3D RESOLUTION WHEREAS the Act of the 59th Texas Legislature, Regular Session, 1965, approved May 6, 1965, entitled Senate Bi II 165 (V.A.C.S. 6081 r), as amended authorized the Texas Parks and Wildl ife Department to make grants to municipal ities and counties to assist them in carrying out programs of outdoor recreation to preserve an adequate amount of rapidly disappearing land; and WHEREAS it has been found and determined by this body that there exists in this local ity a need for a program of publ ic outdoor recreat i on; and WHEREAS Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, or national origin under any program or activity receiving Federal financial assistance and.Executive Order 11063 prohibits discrimination on basis of race, color, creed or national origin in sale, lease or other disposition of residential property (including land intended for residential use) or in the use of occupancy therefore: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS" TEXAS: Section 1. That an appl ication be filed with the Texas Parks and Wildlife Department on behalf of the City of San Marcos for a publ ic outdoor recreation facil ity grant under authority of the Act of the 59th'Texas Legislature, Regular Session, 1965, approved May 6, 1965, entitled Senate Bi II 165 (V.A.C.S. 6081 r), as amended, for one-half the cost of undertaking and carrying out a publ ic outdoor recreation faci I ity program which cost is now estimated to be $20,000 in an area to be designated and specially described in such appl ication and that the City Manager, James B. Baugh, is hereby authorized and directed to execute and file such appl ication and to execute such contract or contracts as may be necessary for the grant appl ied for, and is further author i zed and directed to prov i de such add i t i ona I i nformat i on and furnish such documents as may be required by the Texas Parks and Wildl ife Department and to act as the authorized representative of the City of San Marcos in the execution of the proposed outdoor recreation program; and the City Treasurer, Sam Huey, is hereby authorized to execute and file requisition for funds and act as the authorized fiscal representative of the City of San Marcos in the accompl ishment of the publ ic outdoor recreation program. Section 2. That the United States of America and the Texas Parks and Wildlife Department be, and they hereby are, assured a ful I compl iance by the City of San Marcos, Texas, with regulations of the Texas Parks and Wildl ife Department effectuating Title VI of the Civil Rjghts Act of 1964 and appl icable Executive Orders.
