1972-12 I AN ORDINANCE AMENDING APPENDJX "A" OF THE CODE OF ORDINANCES OF THLCITY .OF SAN .MARCOS, TEXAS, EN- TITLED "GENERAL ZONING ORDINANCE", BY THE ADDITION TO SECTION 11 THEREOF OF A SUB-SECTION (TO BE .NUMBERED 13) FOR'B\IDDING ESTABLISHMENTS WHICH DIS.,. PENSE LIQUOR, WINE OR BEER WITHIN AN "M" SINGLE, DUPLEX, MULTIPLE FAMILY DWELLING AND NEIGHBORHOOD BUSINESS DISTRICT; AND BY THE ADDITION TO SECTION 13 THEREOF OF A SUB-SECTION (TO BE NUMBERED 3) ALLOWING RESTAURANTS OR CAfES WHICH. DISPENSE LIQUOR, WINE OR BEER FOR ON-PREMISES CONSUMPTIONllNDER PER- MIT BY THE STATE OF TEXAS WITHIN A COMMERCIAL DISTRICT "C"; AND BY THE ADDITION TO SAID ORDINANCE OF ANEW SECTION (TO BE DESIGNATED SECTION 13.1 COMMERCIAL DISTRICT C-2) ALLOWING ESTABLISHMENTS OTHER THAN RESTAURANTS OR CAFES WHICH DISPE,NSE LIQUOR, WINE OR BEER FOR ON-PREMISES CONSUMPTION BY PERMIT OF THE STATE OF nXAS;AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF SAN MARCOS: That Section 11 entitled "M" single, duplex, multifamily dwellings and neighborhood businesses be amended by the inclu- sion of an addition~1 exception: 13. Exception: I Establ ishments which dispense I iquor, wine or beer for on-premises consumption under permit by the State of Texas. And furthermore, be it ordained, that SectioJ113 entitled Commercial District "C" be amended by the inclusion of the fo I I ow i ng : 3. Restaurants or cafes which dispense I iquor, wine or beer for on-premises consumption under permit by the State of Texas. Such restaurants or cafes must provide avail- abi I ity of food service during all hou'rs that the establ ish- ment is open to the publ ic. And furthermore, be it ordained, that thefolJowing new section be added: Section 13.1 Commercial District "C-2" In a "C-2" Commercial District no land shal I be used and no building shall be erected or converted to any other use than the fol lowing: I 1. Establ ishments other than restaurants or cafes which di spense liquor, wine or. beer for on-premises consump,t i on by permit by the State of Texas.
