<br />I <br /> <br />I <br /> <br />I <br /> <br />1972-17 <br /> <br />AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF <br />ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, <br />ENTITLED "WATER AND SEWERS AND SEWAGE DISPOSAL" <br />BY DELETING SECTION 30-35 RATES OF ARTICLE I I <br />THEREOF; SUBSTITUTING A NEW SECTION UNDER THE <br />SAME NAME AND NUMBER; AND DECLARING AN EMERGENCY <br /> <br />-BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />I. <br /> <br />That the present Section 30-35 Rates of the Code of Ordinances <br />of the City of San Marcos, Texas, be deleted and an entirely <br />new section under the same name and number be substituted <br />therefor, so that said section shal I henceforth read as fol lows: <br /> <br />Sect i on 30-35 Rates <br /> <br />The rates or charges for services to users of the sanitary <br />sewage system of the City shall be as follows: <br /> <br />(A) Residenti'al users, including and I imited to single <br />family and duplex residential users; $2.00 for the first 2,000 <br />gal Ions of water consumed, plus $.15 per 1,000 gallons or any <br />part thereof in excess of 2,000 gallons, not to exceed $5.60 <br />per month for sewer service. <br /> <br />(S) Commercial users; including but not I imited to office <br />bui Idings, fi I I ing stations, cleaning and pressing stores, cafes, <br />drug stores, furniture stores, apartment houses, hotels, mobile <br />home parks, dry goods stores, bakeries, and any other business <br />establ ishment not herein enumerated; $2.00 for the first 2,000 <br />gallons of water consumed, plus $.25 per 1,000 gallons or any <br />part thereof in excess of 2,000 gallons per month. <br /> <br />(C) All educational institutions with in-resident students <br />~hall pay $0.30 per 1,000 gallons calculated on the following <br />formula: <br /> <br />Resident students X 50 gal Ions per day <br />Non-resident students X 15 gal Ions per day <br />Faculty and Staff X 15 gallons per day <br /> <br />(D) The schedule of minimum charges herein provided shal I <br />apply for each month during the time these rates and charges are <br />in effect, or for any fractional part of a month. <br /> <br />(E) The charges levied and assessed by this section are and <br />shall be levied and assessed against the person in whose name the <br />water meter at such place, building, structure or establ ishment is <br />I isted and assessed. Any reference made to any person, building, <br />structure, business or establishment of any kind in this section <br />shal I be construed as being made to the person in whose name the <br />estab I i shment is I, i sted and assessed. <br /> <br />II. <br /> <br />Inasmuch as charges for sewage services must be processed and <br />issued immediately, an emergency exists, requiring that the <br />provisions of the Charter of the City of San Marcos, Texas, which <br />
