N <br /> <br />t.o <br /> <br />O <br /> <br /> ORDINANCE NO. 2003- 3 <br /> <br />O <br />._~N ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />C,'SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING LOTS 26-45, <br />BLOCK 1 AND LOTS 1-16, BLOCK 7 OF THE HILLS OF <br />HAYS SUBDIVISION, LOCATED IN THE 700 BLOCK OF <br />CLEARVIEW CIRCLE AND THE 700 BLOCK OF ASHLEY <br />COURT, FROM "DP-2" TWO-FAMILY DWELLING DISTRICT <br />TO "R-2" SINGLE-FAMILY DWELLING DISTRICT; <br />INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />139. <br /> <br />RECITALS: <br /> <br /> 1. On November 26, 2002, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "DP-2" Two-Family <br />Dwelling District (Medium Density) to "R-2" Single-Family Dwelling District (Medium <br />Density) for Lots 26-45, Block 1 and Lots 1-16, Block 7 of the Hills of Hays Subdivision, <br />located in the 700 Block of Clearview Circle and the 700 Block of Ashley Court. <br /> <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on November 26, 2002, consider and vote to approve the request, and has recommended that <br />the request be approved by the City Council of the City. <br /> <br /> 3. The City Council held a public hearing on the 13th <br />2003, regarding the request. <br /> <br />__day of January, , <br /> <br /> 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to <br />zoning map amendments have been met. <br /> <br /> 5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of <br />the San Marcos City Code, is amended to rezone the following real property which is presently <br />zoned "DP-2" Two-Family Dwelling District (Medium Density) to "R-2" Single-Family <br />Dwelling District (Medium Density): <br /> <br />Street address: 700 Block of Clearview Circle and the 700 Block of Ashley Court. <br /> <br /> <br />
