<br />ORDINANCE NO. 2004 - 22 <br /> <br /> 159. <br />(') ~ <br />;::¡: » <br />"<(') '"0 <br />0- ::::t:J <br />--f <br />00-< ~ <br />1»0 <br />:3r QO g.m <br />~m '" ~O <br />I»:JJ C) <br />ë;^ C) t6 <br />0 ~ <br />rn <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, READOPTTNG <br />AND CONTINUING ARTICLE 3, CURFEW, OF <br />CHAPTER 54, MISCELLANEOUS OFFENSES, OF THE <br />CITY CODE IN ACCORDANCE WITH STATE LAW; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. LOC. GOV. CODE §370.002 requires the City Council, once each three years, <br />to review the City's juvenile curfew ordinance (City Code Chapter 54, Article 3), its <br />effects on the commlUlity and on problems the ordinance was intended to address, and to <br />hold public hearings on the need to continue the ordinance. <br /> <br />2. The City Council held public hearings on Ap'o-; 1 1? ,2004 and on <br />April 26 2004, on the need to continue the curfew ordinance. <br /> <br />3. The City Council has determined that the r:urfe\v ordinance should be continued in thè <br />interest of the public health, safety and welfare. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. Article 3, Curfew, of Chapter 54, Miscellaneous Offenses, of the <br />City Code is readopted and continued in the form attached to this ordinance. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be lUlconstitutional or invalid by a cou11 of competent jurisdiction, <br />the remaining provisions of tIlls ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> <br />SECTION 3. All ordinances and resolutions or pal1s of ordinances or resolutions <br />in conflict herewith are hereby repealed. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 5. This Ordinance will take effect 10 days after the date of its final <br />passage, and the City Secretary will publish notice of its adoption in a newspaper of <br />general circulation in the City. <br />
