52. ORDINANCE 2002-~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 2.9 ACRE TRACT OF PROPERTY LOCATED IN THE 1300 BLOCK OF WONDER WORLD DRIVE FROM IMF_5" MULTI-FAMILY DISTRICT (HIGH DENSITY) TO "LB" LIMITED BUSINESS DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. On November 13, 2001, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from ''''MF-5" Multi- Family District (High Density) to "LB" Limited Business District for a 2.9 acre tract of property located in the 1300 Block of Wonder World Drive. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on November 13,2001 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 28-th day of January 2002, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest ofthe public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned IMF_5" Multi-Family District (High Density) to "LB" Limited Business District: Street address: 1300 Block of Wonder World Drive. Size: 2.9 acres. Legal description: See the metes and bounds description attached as Exhibit A.
