ORDINANCE NO. 2009 - 8 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS AMENDING THE TRAFFIC <br />REGISTER MAINTAINED UNDER SECTION 82.067 OF <br />THE SAN MARCOS CITY CODE BY THE ADDITION OF <br />NUMBER, TIME AND USE RESTRICTED PARKING <br />ALONG THE 200 BLOCK OF RIDGEWOOD STREET, <br />INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br />RECITALS: <br />1. The Traffic Register, required by Section 82.067 of the City Code of <br />Ordinances, needs to be amended to include a limited number of hour restricted <br />street parking along the 200 block of Ridgewood Street in the Holland Hills <br />neighborhood for the purpose of prohibiting student parking in the residential <br />neighborhood. The additional parking is a result of spill over parking from parking <br />restrictions previously placed in the Alamo Heights neighborhood. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1: Pursuant to Sections 82.160 and 82.161 of the City of San <br />Marcos Code of Ordinances, the Traffic Register maintained under 86.067 of the <br />City Code is amended by adding the following time and use restricted parking: <br />. 200 Block of Ridgewood Street, both sides, shall be designated as no parking <br />zone, except for eight spaces along the Schulle Canyon Park side as designated on <br />Attachment A (parking space location map), and subject to the following two <br />conditions: <br />(1) 200 Block of Ridgewood Street, Schulle Canyon Park side only, <br />establish a restricted parking zone daily from 6:00 a.m. until sunset. <br />(2) 200 Block of Ridgewood Street, Schulle Canyon Park side only, <br />establish a restricted parking zone for park users only. <br />SECTION 2: If any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent <br />jurisdiction, the other provisions of this ordinance will continue in force if they can be <br />given effect without the invalid portion. <br />SECTION 3: All ordinances and resolutions or parts of ordinances or <br />resolutions in conflict with this ordinance are repealed. <br />SECTION 4: Any person violating any provision of this ordinance commits a <br />civil offense and is subject to the penalty provided in Section 82.159 of the San <br />Marcos City Code. <br />SECTION 5: This ordinance shall be in effect ten (10) days from and after its <br />passage, and the City Clerk will publish notice of its adoption in a newspaper of <br />general circulation in the City.
