<br /> <br /> <br />57. <br /> <br />ORDINANCE NO. 2001 - 9 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS DEDICATING VARIOUS TRACTS OF <br />REAL PROPERTY IN THE CITY FOR PARK PURPOSES; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br /> <br />RECITALS: <br /> <br />1. The Parks and Recreation Board has recommended that the City Council formally <br />dedicate for park purposes the tracts of real property described on the map attached to this ordinance. <br /> <br />2. The City Council wishes to dedicate for park purposes the tracts of property described <br />as "To be dedicated" on the map attached to this ordinance, to bring these tracts within the <br />restrictions imposed by Section 3.07 (b )(1) of the City Charter. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The tracts ofreal property shown on the attached map as "To be dedicated" are <br />hereby dedicated for park purposes. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in full force if they can be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 4. This Ordinance will take effect ten days after the date of its final passage, and <br />the City Secretary will publish notice of its adoption in a newspaper of general circulation in the <br />City. <br /> <br />PASSED AND APPROVED on first reading December 17, 2001. <br /> <br />PASSED AND APPROVED ON second reading January 14, 2002. <br /> <br />PASSED, APPROVED AND ADOPTED 2002 . <br /> <br /> <br />C:\TEMP\Parkland dedication. doc <br />
