• RESOLUTION NO. 2011- 1 OR <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, FINDING IT NECESSARY TO PROVIDE FOR <br />PUBLIC INVOLVEMENT UNDER SECTION 106 OF THE NATIONAL <br />HISTORIC PRESERVATION ACT IN CONNECTION WITH THE <br />STABILIZATION AND REHABILITATION OF THE CEPHAS HOUSE, A <br />HISTORICALLY SIGNIFICANT STRUCTURE, LOCATED AT 217 MLK <br />BOULEVARD; AUTHORIZING CITY STAFF TO IDENTIFY <br />INTERESTED STAKEHOLDERS; AUTHORIZING CITY STAFF TO <br />CONDUCT SUCH PUBLIC MEETINGS AND HEARINGS AS MAY BE <br />REQUIRED UNDER SAID ACT AND TO NOTIFY INTERESTED <br />STAKEHOLDERS AND THE PUBLIC OF THESE MEETINGS AND <br />HEARINGS; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. In 2002 the City acquired the Cephas House located at 217 W. MLK using <br />Community Development Block Grant (CDBG) funds. <br />2. The City has determined the Cephas House to be a historically significant <br />structure and the Texas Historical Commission has similarly determined that the structure is <br />• eligible for listing on the National Register of Historic Places. <br />3. The City Council has authorized the expenditure of additional CDBG funds to <br />stabilize and rehabilitate the structure due to its historical significance. <br />4. As a condition of Texas Historical Commission approval of WORK ON THE <br />Cephas House and before spending the CDBG funds, Section 106 of the National Historic <br />Preservation Act requires the City to inform the public of the project and to receive public input. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The City Council finds that it is necessary under Section 106 of the <br />National Historic Preservation Act (the "Act ") to provide for public involvement in connection <br />with the stabilization and rehabilitation of the Cephas House located at 217 MLK Boulevard. <br />PART 2. City staff is hereby authorized to identify interested stakeholders in <br />connection with the Cephas House stabilization and rehabilitation. <br />PART 3. City staff is further authorized to conduct such public meetings and <br />hearings and to notify the interested stakeholders and public of these meetings and hearings as <br />• may be required under the Act. <br />
