89. ORDINANCE 2002- 10 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.6 ACRE TRACT OF PROPERTY LOCA TED IN THE 1300 BLOCK OF WONDER WORLD DRIVE FROM "LB" LIMITED BUSINESS DISTRICT TO "MF-5" MULTI-FAMIL Y DISTRICT (HIGH DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. On November 13, 2001, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "LB" Limited Business to "MF-5" Multi-Family District (High Density) for a 0.6 acre tract of property located in the 1300 Block of Wonder World Drive. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on November 13, 2001 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 11 th day of February , 2002, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City COlmcil hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "LB" Limited Business District to "MF-5" Multi-Family District (High Density): Street address: 1300 Block of Wonder World Drive. Size: 0.6 acres. Legal description: See the metes and bounds description attached as Exhibit A.
