<br /> <br /> <br /> <br />94. <br /> <br />ORDINANCE NO. 2002- 14 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE CITY'S <br />ELECTRIC UTILITY RATE SCHEDULES TO REVISE <br />ELECTRIC UTILITY DEPOSIT POLICIES AND TO <br />REVISE ELECTRIC BILL PAYMENT DUE DATES, <br />PENAL TY DATES AND DISCONNECTION DATES; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br /> <br />RECITALS: <br /> <br />1. The Finance Department has recommended that the electric utility rate schedules <br />adopted in Section 86.167 of the City Code be revised to provide more uniformity in utility <br />deposit policies for persons who have previously established good credit as customers of the <br />City's utilities. <br /> <br />2. The Finance Department has also recommended that the electric utility rate schedules <br />be revised to adopt a uniform table for utility payment due dates, penalty dates and disconnection <br />dates. <br /> <br />3. The City Council wishes to implement these recommendations by adopting revised <br />electric utility rate schedules. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The City's electric utility rate schedules established under City Code <br />Section 86.167 are repealed and are replaced by the electric utility rate schedules attached to this <br />ordinance. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any proVISIOn of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City <br />Code upon conviction. <br /> <br />SECTION 5. This Ordinance will take effect 10 days after the date of its final passage, <br />and the City Secretary will publish notice of its adoption in a newspaper of general circulation in <br />the City. <br /> <br />PASSED AND APPROVED on first reading January 14, 2002. <br /> <br />C:\TEMP\electric rate schedule adoption. doc <br />
