<br />103. <br /> <br />RESOLUTION NO. 2002 - 21 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING THE CONVEYANCE <br />OF A TEMPORARY CONSTRUCTION EASEMENT TO FIVE <br />TREE, LIMITED IN EXCHANGE FOR TWO PERMANENT <br />EASEMENTS WITHIN THE RANCH ROAD NO. 12 <br />APARTMENTS SUBDIVISION; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE THE TEMPORARY <br />CONSTRUCTION EASEMENT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. Five Tree Limited is the owner of a Lot 1, Ranch Road No. 12 Apartments <br />Subdivision, and the City is the owner of Lot 2 of the same subdivision. <br /> <br />2. Five Tree, Limited is requesting a temporary construction easement for five <br />areas in Lot 2, to be utilized during the construction of an apartment complex. In exchange <br />for these temporary construction easements, Five Tree, Limited will convey two permanent <br />easements in Lot 1 to the City. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The conveyance of the attached Temporary Construction Easement to <br />Five Tree, Limited is approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the attached <br />conveyance on behalf of the City. <br /> <br />PART 3.
