Oal <br />~ >Cf) <br />CD 1-- <br />LtJ -0 <br />l.L.. 0>- <br />"( .~ <br /> 0 <br /> <br />33. <br /> <br />ORDINANCE NO. 2005--2-6- <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING AN AMENDMENT TO <br />THE FUTURE LAND USE MAP FROM HIGH DENSITY <br />RESIDENTIAL TO COMMERCIAL FOR A 3.0 ACRE TRACT <br />OF LAND LOCATED AT 1400 WONDER WORLD DRIVE; <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING THIS TRACT FROM "MF-3" MULTI-FAMILY <br />DISTRICT (HIGH DENSITY) TO "OP" OFFICE <br />PROFESSIONAL DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On January 11,2005, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from high density residential to commercial, and a concurrent request <br />to change the zoning from "MF-3" Multi-Family District (High Density) to "OP" Office <br />Professional District, for a 3.0 acre tract ofland located at 1400 Wonder World Drive. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on January 25, 2005 consider and vote to approve the requests, and has recommended that <br />the requests be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the ?1 f':t- day of March <br />2005, regarding the requests. <br /> <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Future Land Use Plan ofthe San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from high <br />density residential to commercial: <br /> <br />Street address: 1400 Wonder World Drive. <br /> <br />Size: 3.0 acres. <br />
