<br /> <br /> <br /> <br />ORDINANCE 2002- 22 <br /> <br />30. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING A 23.7 ACRE <br />TRACT OF PROPERTY LOCATED AT 1610 IH 35 NORTH <br />FROM "C" COMMERCIAL DISTRICT AND "Ll" LlGHT <br />INDUSTRIAL DISTRICT TO "MF-4" MULTI-FAMIL Y <br />DISTRICT (HIGH DENSITY); INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On January 8, 2002, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the zoning from "C" Commercial District and <br />"Ll" Light Industrial District to "MF-4" Multi-Family District (High Density) for a 23.7 <br />acre tract of property located at 1610 IH 35 North. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on January 22, 2002 consider and vote to approve the request, and has recommended that <br />the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 25th day of March <br />2002, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to <br />zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of <br />the San Marcos City Code, is amended to rezone the following real property which is presently <br />zoned "C" Commercial District and "Ll" Light Industrial District to "MF-4" Multi-Family <br />District (High Density): <br /> <br />TRACT 1: <br /> <br />Street address: 1610 IH 35 North. <br /> <br />Size: 15.1 acres. <br />
