<br /> <br /> <br /> <br /> <br /> <br />36. <br /> <br />ORDINANCE NO. 2002- 25 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS AMENDING SECTION 2.091(b) <br />OF THE CITY CODE TO REVISE RESIDENCY <br />REQUIREMENTS FOR MEMBERS OF THE PLANNING <br />AND ZONING COMMISSION; PROVIDING FOR <br />PENAL TIES; AND INCLUDING PROCEDURAL <br />PROVISIONS. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 2.091(b) of the City Code is amended as follows (underlining <br />indicates added language and overstrike indicates deleted language): <br /> <br />(b) To be eligible for appointment and continued service on the commission, all of the <br />regular commission members except tWft-one will reside and own real property in the <br />city, B-fl:€-efand the remaining regular members will reside and own real property in the <br />city's extraterritorial jurisdiction,.--atttl the other remaining regular member \vill reside in <br />the city or the oit)":; extraterritorial jurisdiction, and ovm real property in the city or the <br />e.ity2&-e*t.mtcrritorial jtl:f-i:sEH€tiB-n. One of the alternate members will reside and own real <br />property in the city, and the other alternate member may reside and own property in the <br />city's extraterritorial jurisdiction. The regular member of the commission who resides and <br />owns property in the city's extraterritorial iurisdiction must abstain from the <br />commission's discussion and vote on any matter involving city land use regulations that <br />apply only within the city, including, without limitation, those under chapter 114 of this <br />Code; the member may discuss and vote on all other matters coming before the <br />commISSIOn. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 4. This Ordinance will take effect 10 days after the date of its final passage, <br />and the City Secretary will publish notice of its adoption in a newspaper of general circulation in <br />the City. <br /> <br />PASSED AND APPROVED on first reading February 25, 2002. <br /> <br />PASSED AND APPROVED on second reading March 4, 2002. <br /> <br />C:\TEMP\PZ revisions 3.02.doc <br />
